Dear Mr. Berry:
By letter dated June 26, 1979, you forwarded an, " Application for Amendment to Operating License" for the James A. FitzPatrick Nuclear Plant. This proposed amendment would reduce pump performance requirements for the Emergency Service Water System.
In addition, you indicated that the restart of FitzPatrick will be contingent on this modification.
Since ret.eipt of your application the Office of Inspection and Enforcement har forwarded to you by letter dated July ll,1979, IE Bulletin 79-15, Deep Draft Pump Deficiencies. Since the Emergency Service Water Pumps are similar to the vertical turbine pump design discussed in Bulletin 79-15, approval of your proposed amendment is contingent on your satisfactory response to the Bulletin.
Due to the aforementioned, please be advised that your application is being held in abeyance.
Your earliest response to Bulletin 79-15 and scheduled FitzPatrick restart date would be appreciated.
