Dear Mr. Hackett:

This is in response to your letter to President Nixon dated Tbrch 25, 1970.

On June 1. Jersey Central Power & Light Company filed an application with the Atomic Energy Cocmission (AEC) for a construction permit to build a nuclear power plant to be called the Forked River Nuclear Generating Station Unit 1, in Ocean County, New Jersey, and the AEC regulatory staff and the Commission's Advisory Committee on Reactor Safeguards are proceeding with their review of the application. Before any determination is nade on the application for this plant, a public hearing will also be held before an atomic safety anc licensing toard at some place in the vicinity of tae proposed facility.

Sites for nuclear power plants are selected by the utilities procosing to build the facilities, and the AEC review of the site and the cesign of a proposed plant is made from the stand?oint of radiological healtn and safety, and the common defense and security. Such other factors, however, as zoning, placement of transmission lines, and esthetics, are subject to the same appropriate jurisdictions for nuclear plants as for plants fueled by coal, oil, or other nonnuclear reans.

The Water quality Improvement Act of 1970 (copy enclosed) requires applicants for a construction permit or operating license for any nuclear power plants which will cause any discharge into the navigable waters of the United States to provide the AEC with certification from the State or interstate water pollution control agency, or the Secretary of the Interior, as appropriate, that tnere is reasonable assurance that the plant will not violate applicable water quality standards. The AEC would generally be prohibited from issuing any such permit or license unless such certification is provided.

Mr. Richard W. Hackett construction pcmits for nuclear power plants which will be dependent upon water resources for plant cooling purposes.

In addition to its cements on the radiological health and safety aspects of the proposed facility, the Service also makes recemendations on nonradiological matters, including the themal effects of the discharge of coolant water.

This report is made public, and the AEC sends a copy to the applicant calling attention to the Service's recomendations carcerning potential nonradiological effcets.

I am enclosing a current statement of general policy which indicates the manner in which the Comission proposes to exercise its responsibilities under the National Enviromental Policy Act of 1969.

Also enclosed are three booklets which you may find of interest; namely,

" Licensing of Power Reactors," which describes AEC procedures for the review and evaluation of each application and its continuing surveillance over operating nuclear plants; " Atomic Power Safety," which describes power reactors and the development of standards to limit radioactivity from nuclear power plants; and " Nuclear Power and the Environment,"

which describes scoe AEC and utility programs concerned with research on the effects of releases of radioactivity and heated water from such plants.

The Jersey Cantral Powcr & Light Ccapaav har. announced its plans to install another nuclear power plant in Lacey Township. The building will be twice the size of the present plant, located west of Route f? in the South portion of Lacey Townchip, on a site containin? 000 or more acres and zoned industrial. The desire of the Company to install the proposed plant in a rural :ene, closer to Barnegat Bay shore and closer to the mouth of Oyster Creek and Forked River an the East side of Route #9 in the South-cast portion cf the Township, r.ad also in the middle of approximately 1100 homes is a radical change fr;m their originally stated plans.

The ccnstruction vf this proposed industrial building on or near Earn-egat Day will be the first blight of this type, if permitted, on the Bay front f rca Bay Head to Tuckerton, consisting of 70 miles of bay shore.

The Ccapany originally annernced plans to use its industrial zened SCO acres West of Route #9 (the present plant site) for additional power pro-ducing plants.

It did net purchas the additional acreage on the Ea.t side of Route #9 until scte tLne later.

The Plants, it is understood, will supply power to three or core states including a large portion of New Jersey.

If cost is one of the factors for the desire to switch the proposed location at this late date, installing the propcsed plant in its original industrial :oned location should not be a burden to the Power Company because the Ccapany will be reimbursed by con-sumers being supplied with pcwar over a three state area. However, if the Ccmpany is trying to locate as close as possible to home sites so that fu-ture plants may be installed in cities or close to recreational areas, then it is time to stop this action. The Power Ccapany has not explained to the Public the dire necessity for the proposed location in a rural zene or if the prcximity to such a large number of hcces is scFe for the hc=e owner aad their fa=ilies. Questions concerning all of the abo ~e and others too nt:-

erous to sention will net have a chance to be asked or answered if sudden action was to be taken by the Planning Board of Lacey :ownship and the Town-ship Co=sittee.

We do not feel that the rezoning of rural :une to industrial zone in this case particularly should even be considered before all the people in the Tounship have had ample opportunity to hear all the facts.

The length, size and depth under Bay of pipeline to Ocean, distance frcm shore (Long Beach Island State Park) to outfall, temperature of water at outfall in Ocean, radicactive residue or any cther waste material trans-ported by the preposed pipe, should be disclosed at this time.

If the very valuable water front land purchased by the Pcwer Ccapam, east of Rcute 19 was net used for the proposed plant site it cculd be sold and might help the Power Ccapany to reduce their everall cost and might evcn result in a lower rate of increase than 13; nou being sought.

.~. 3 objection to the ?lant being located on its originally planned locc: ion, the Pcwer Company, iccal, state and federal governing bodies, but we want ccanissions and authorities to be sure tha: the Plant is efficiently con-structed and operated safely in the right loca:ica, thus resulting in more ele ct ricity for the.. consumers at a lower cos.

If not supervised, we feel that indiscrimina:e loca:ing of any industrial cceplex could blight and contc=inate the envircnment of our Township and County. W2 reques: the Planning Board of Lacey Township, the Ocean County Planning Board and :he Township Ccemittee to take the ci e to explain to the public all of :he factors concerning, this monumental decision of theirs. This is a major move af fecting our Rivers, Bays and Ocean anc w'll definitely have a grea; effec: on our lives and the lives of cur families for years and years to ccme.
