Dear Ms. Sweatt:

This letter is to inform you that the U.S. Nuclear Regulatory Commission (NRC) has approved an Agreement with the State of Vermont under Section 274 of the Atomic Energy Act of 1954, (AEA) as amended. The Commission has determined that the Vermont program for the regulation of materials covered by the Agreement is compatible with the Commissions program and is adequate to protect public health and safety. Under this Agreement, Vermont has assumed regulatory authority over byproduct material as defined in Sections 11e.(1), 11e.(3),

and 11e.(4) of the AEA, source material, and special nuclear material in quantities not sufficient to form a critical mass in the State. The Agreement became effective on September 30, 2019.

The NRC staff will conduct periodic reviews of the Vermont program to ensure that the terms of the Agreement continue to be met.
