2.206 Petition - Request for Enforcement Action Related to TMI Steam Generators Eric/Scott, During our meeting on June 26, 2019, you asked a question regarding appeal rights for petitions.
Neither Management Directive 8.11 Review Process for 10 CFR 2.206 Petitions or the regulations found in 10 CFR 2.206 provide an appeal process for a petition that is not accepted for review. Similarly, for petitions that are accepted for review, while the Commission may choose to review a Directors decision on its own volition, the regulations state that [n]o petition or other request for Commission review of a Directors decision under this section will be entertained by the Commission.
Having said that, I did receive your email Thursday with your supplement to the petition. It is in the process of being added to ADAMS as a publicly available document. The PRB is taking the statements you made in the supplement into consideration in making its final decision. Once that decision has been made, I will contact you to let you know of the Boards decision prior to the formal letter being issued.
