SUMMARY

OF A PUBLIC MEETING WITH SOUTHERN NUCLEAR OPERATING COMPANY ON JUNE 13, 2019 The U.S. Nuclear Regulatory Commission (NRC) staff held a Category 1 public meeting with Southern Nuclear Operating Company (SNC) on June 13, 2019. The purpose of the meeting was to discuss future license amendment requests for modifying the required inspections, tests, analyses, and acceptance criteria (ITAAC), the diverse and flexible coping strategy (FLEX) implementation plan, and submittal of ITAAC closure notifications prior to the Title 10 of the Code of Federal Regulations (10 CFR) 52.103(g) finding for SNCs Vogtle Electric Generating Plant (VEGP) Units 3 and 4.

J. Dixon-Herrity Summary of Meeting:

On June 13, 2019, staff from the NRC conducted a public meeting with representatives from SNC to discuss future license amendment requests for modifying the ITAAC, the FLEX implementation plan, and submittal of ITAAC closure notifications prior to the 10 CFR 52.103(g) finding for SNCs VEGP, Units 3 and 4.

FLEX Implementation Plan SNC briefed their presentation (ADAMS Accession No. ML19151A885) to the staff, and the staff and SNC discussed the proposed plan for implementation of the Commission Order with Regard to Mitigation Strategies for Beyond-Design-Basis External Events and the associated rulemaking for 10 CFR 50.155 at VEGP, Units 3 and 4. SNC took an action to consider submitting an overall integrated plan update formatted more like a final integrated plan with the six-month update scheduled to be submitted to the NRC in August 2019. This submittal would present aspects that are important to document considering the unique features of the AP1000 design. SNC also provided information regarding the Near Term Task Force Recommendation 9.3, Communication and Staffing Assessments. SNC plans to submit the Communications Assessment in July 2019 and proposed that the Staffing Assessment commitment be revised to submit the assessment prior to the Unit 4 fuel load instead of the Unit 3 fuel load. SNC anticipates the commitment change letter would be submitted in the July 2019 timeframe. The NRC took an action to provide a formal response to the change in commitment.

Functional Arrangement ITAAC Optimization Prior to the meeting, SNC provided the staff a draft copy of the LAR (ADAMS Accession No. ML19155A069). SNC briefed their presentation (ADAMS Accession No. ML19164A186) to the staff. The staff provided feedback to emphasize any testing which shows functional arrangement for lesser safety significant systems is sufficient. In addition, the staff provided feedback to ensure certain functional arrangement ITAAC that are proposed to be removed are still covered by other ITAACs. SNC indicated the LAR was on track to be submitted by the end of June 2019. SNC and the NRC staff noted the complexity of the LAR and agreed that this could benefit from periodic status meetings to discuss the progress in each review area.

Optimization for Nonsafety-Related ITAAC In SNCs presentation (ADAMS Accession No. ML19164A187), SNC explained they are evaluating a potential LAR and exemption request to reduce ITAAC with minimal safety significance using the concepts described in SECY-19-0034, Improving Design Certification Content, dated April 8, 2019 (ADAMS Accession No. ML19080A032) for Tier 1 content. SNC explained that the LAR and exemption will not result in any changes to the plant and will retain the design descriptions, figures, and tables. SNC explained the methodology they are using to screen ITAAC into the scope of the LAR, provided examples of ITAAC that screened into the LAR and examples that did not, and clarified that they will not be requesting approval of the screening methodology. Instead SNC will be seeking approval of specific ITAAC changes. The staff provided feedback to explain that while the screening process is used by SNC to identify potential ITAAC for optimization, the staff will need to evaluate the proposal against the regulatory requirements to determine if the ITAAC are necessary or can be deleted. SNC noted that they expect to have a draft LAR to the NRC by July 11, 2019 in preparation for a July 25, 2019 pre-submittal meeting. The NRC staff took an action to start to develop a review and acceptance criteria for discussion at the July 25, 2019, pre-submittal meeting.

J. Dixon-Herrity Time Between ITAAC Complete Letter and 103(g)

SNC briefed their presentation (ADAMS Accession No. ML19151A881) to the staff, which focused on the timeline of events specified in LIC-114, Title 10 of the Code of Federal Regulations (10 CFR) 52.103(g) Finding and Communication Process, dated January 21, 2019 (ADAMS Accession No. ML18267A001), that occurs between the ITAAC complete letter and the 10 CFR 50.103(g) finding. SNC also presented examples of scenarios for the worst case ITAAC Closure Notification (ICN) and post closure notification scenarios. There were three actions items resulting from the discussion. First, due to the compressed timeline, SNC will work with the staff to assure test procedures and draft products are provided well ahead of the ICN being issued. The NRC staff will look to determine the best strategy for SNC to share this type of information to streamline the ICN review while still maintaining transparency. Secondly, SNC presented several scenarios where post closure notifications are submitted after the Commission is given the 10 CFR 52.103(g) finding documentation. The NRC staff will look to develop a strategy for this scenario as well as relook at LIC-114 to see where other areas can be streamlined. Lastly, SNC will review their schedule to strategically plan and coordinate tabletop exercises.

At the conclusion of each presentation, there was an opportunity for the public to provide comments and ask questions. There were no comments or questions from the public.
