APPLICATION FOR ORDER CONSENTING TO TRANSFER OF LICENSES AND CONFORMING LICENSE AMENDMENTS (EPID-L-2019-LLM-OOOO)

Dear Mr. Hamilton:

By letter dated April 26, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19116A087), FirstEnergy Nuclear Operating Company (FENOC),

acting on behalf of itself and FirstEnergy Nuclear Generation, LLC (FENGen) (together, the Applicants) submitted an application for an order consenting to the transfer of the licenses for Beaver Valley Power Station, Unit Nos. 1 and 2; Davis-Besse Nuclear Power Station, Unit No. 1; and Perry Nuclear Power Plant, Unit No. 1, and their respective generally licensed independent spent fuel storage installation facilities (ISFSls). The application also requests conforming license amendments to update the entity names on the licenses and modify the

$400 million support agreement. Portions of the letter dated April 26, 2019, contained sensitive unclassified non-safeguards information and, accordingly, have been withheld from public disclosure pursuant to Section 2.390 of Title 10 of the Code of Federal Regulations ( 10 CFR).

By letter dated May 31, 2019 (ADA-MS Accession No. ML19151A531 ), in response to the U;S.

Nuclear Regulatory Commission (NRC) staff request dated May 29, 2019 (ADAMS Accession No. ML19143A073), you provided a supplement to your application. The NRC staff has found the supplement responsive to the cited informational needs.

The NRC staff has reviewed your application as supplemented and has concluded that it provides technical information in sufficient detail to enable the NRC staff to begin its detailed technical review and make an independent assessment regarding the approval of the application in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staff's ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the NRC staff's detailed technical review by separate correspondence.

Based on the information provided in your submittal, the NRC staff has estimated that this licensing request will take approximately 550 hours0.00637 days <br />0.153 hours <br />9.093915e-4 weeks <br />2.09275e-4 months <br /> to complete. The NRC staff expects to

complete this review in 6 months, which is October 2019. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager.

These estimates are based on the NRC staff's initial review of the application and they could change due to several factors including requests for additional information, unanticipated addition of scope to the review, and review by NRC advisory committees or hearing-related activities.
