NRC INSPECTION REPORT 150-00017/2019-001 AND NRC CONFIRMATORY ORDER EA-11-043
Dear Mr. Stelly:
This letter refers to the announced inspection conducted on January 31, 2019, and to the confirmatory order issued to Accurate NDE & Inspection, LLC (Accurate NDE), as a result of a successful alternative dispute resolution mediation session held on September 28, 2011. The Order required Accurate NDE to complete certain actions as part of the settlement agreement between Accurate NDE and the U.S. Nuclear Regulatory Commission (NRC). The settlement agreement pertained to an apparent violation of NRC requirements, as discussed in our letter dated July 28, 2011 (Agencywide Documents Access and Management System (ADAMS) Accession ML11209B523).
Confirmatory Order EA-11-043 (ADAMS Accession ML113530799) was issued December 19, 2011, as a result of Accurate NDE employees willfully failing to follow its Louisiana license and NRC regulatory requirements. The order confirmed commitments made as part of the preliminary settlement agreement as stated above, which included the following:
(1) establish and implement a comprehensive training program, (2) conduct field audits of offshore work, (3) develop written procedures for conducting radiography offshore, (4) provide training for on-call managers that may need to respond to events, (5) provide annual submissions of procedures used for radiography offshore or for training individuals working offshore, and (6) payment of a civil penalty in the amount of $13,500.
In response to these requirements, as documented in an NRC inspection on September 20, 2012 (NRC Inspection Report 150-00017/2012-002), and the NRC inspection on January 31, 2019, you provided copies of records demonstrating that you had completed each of the above quoted requirements of the Order within the specified timeframe. Therefore, this letter documents NRCs conclusion that Accurate NDE has been in compliance with the requirements of the Confirmatory Order Conditions V.A through V.G. Please recall that Condition V.G of the Order remains in effect through December 19, 2021, 10 years from the issuance date of the Order. A final briefing for the January 31, 2019 inspection was conducted telephonically with you on May 21, 2019. In accordance with 10 CFR 2.390 of the NRC's "Agency Rules of Practice and Procedure," a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or from the NRC's ADAMS, accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
