UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 June 25, 2019 ALL AGREEMENT AND NON-AGREEMENT STATES ALL STATE LIAISON OFFICERS VERMONT TRIBES PROPOSED AGREEMENT BETWEEN THE STATE OF VERMONT AND THE U.S. NUCLEAR REGULATORY COMMISSION (STC-19-038)

Purpose:

To notify you that the U.S. Nuclear Regulatory Commission (NRC) has published a Federal Register notice (FRN) requesting comments on the proposed Agreement between the State of Vermont and the NRC.

Background:

Governor Philip B. Scott, on behalf of the State of Vermont, has submitted a request that the NRC enter into an Agreement with the Commonwealth pursuant to Section 274 of the Atomic Energy Act of 1954 (AEA). Under the proposed Agreement, the Commission would discontinue, and the State of Vermont would assume, regulatory authority within the State over the responsibility of byproduct material as defined in Sections 11e.(1), 11e.(3), and 11e.(4) of the AEA, source material, and special nuclear material in quantities not sufficient to form a critical mass.

Discussion: In the FRN, the NRC staff summarizes its assessment of the Vermont program for exercising regulatory authority over byproduct material, source material, and special nuclear material in quantities not sufficient to form a critical mass. The draft assessment is Enclosure 2 to SECY-19-0058, Proposed Agreement Between the State of Vermont and the Commission Pursuant to Section 274 of the Atomic Energy Act of 1954, as amended (https://www.nrc.gov/docs/ML1911/ML19115A212.html). Instructions for providing comments can be found in the attached FRN. The comment period ends July 25, 2019.
