Thank you for your recent email to NRC Chairman Svinicki regarding the storage of spent nuclear fuel at San Onofre Nuclear Generating Station.
Every NRC-licensed facility is responsible for the safety and security of its site, including the nuclear materials on the site. For San Onofre, Southern California Edisons responsibility includes the acceptance testing, maintenance, and inspection of dry cask storage systems for spent fuel management.
The NRC ensures licensees such as SCE maintain safety and security by enforcing requirements through licensing and oversight activities. The NRCs review of SCEs acceptance testing, maintenance, and inspection programs (including aging management programs) for dry cask storage systems ensures those programs meet the NRCs regulatory requirements. The NRC will continue reviewing SCEs implementation of its inspection programs, as part of the NRCs Independent Spent Fuel Storage Installation oversight activities.
As was the case for the August dry cask loading incident, any time that regulatory requirements are not maintained, the NRC initiates appropriate enforcement actions to bring the licensee back into compliance with the regulatory requirements.SCE must complete additional actions before the NRC will approve additional dry cask loading operations.
The NRC will continue to apply enforcement actions commensurate with the safety significance of any potential future non-compliance.
In addition, any person may ask the NRC to take enforcement action against a licensee through the provisions of Title 10 Code of Federal Regulations (CFR) Section 2.206.
