Dear Ms. Sweatt:

Governor Philip B. Scott, on behalf of the State of Vermont, has submitted a request that the U.S. Nuclear Regulatory Commission (NRC) enter into an Agreement with the State under Section 274 of the Atomic Energy Act of 1954 (AEA). Under the proposed Agreement, the Commission would discontinue, and the State of Vermont would assume, regulatory authority within the State over the responsibility of byproduct material as defined in Sections 11e.(1),

11e.(3), and 11e.(4) of the AEA, source material, and special nuclear material in quantities not sufficient to form a critical mass.

Enclosed for your information is the Federal Register notice (FRN) published on June 25, 2019.

The FRN requests public comment on the proposed Vermont Agreement and the NRC staff draft assessment of the State of Vermonts formal application. The comment period ends July 25, 2019.
