May 13, 2019 NOTE TO FILE DOCKET 052-00046 APR1400 Design Certification Application (DCA)
SUBJECT:
ADAMS package ML17234A514 containing a submittal letter from KHNP (dated August 22, 2017; ML17234A515) and an enclosure (Response to RAI 541-8724, Question 06.02.05-12; ML17234A517)
On May 9, 2019, I discovered that this package and two documents within have not been declared in ADAMS and made publicly available. After discussion with the Document Processing Center (DPC), we determined that the submittal letter incorrectly stated Enclosure 1 was an affidavit, Enclosure 2 was the proprietary version of the RAI response, and Enclosure 3 was the non-proprietary version of the response. What was submitted was only a single enclosure, the non-proprietary response to the RAI. I asked KHNP to confirm that there was no proprietary response (and no need for an affidavit). On May 10, KHNP confirmed that the letter was incorrect in its identification of the enclosures. There was only the non-proprietary RAI response which the letter identified on the sole enclosure title page. It was for this reason that the package was not initially processed further. At that time, attempts were made to verify and correct the situation. It appears that with the submission of a revised response in November 2017, which provided a markup of the RAI response, staff and DPC ceased resolution of the letter wording.
After confirming the situation, NRC does not consider the errant wording in the submittal letter to be an issue. Since the design certification review was completed using revised versions of the response submitted on November 13, 2017 (ML17317A443) and December 29, 2017 (ML17363A255), both of which provided markups showing the original response and how the revisions changed prior responses, NRC has determined that the letter does not need to be corrected. KHNP agreed with this determination. However, since the two latter responses both reference the initial response, and to complete the record in ADAMS, this letter should be made publicly available.
Therefore, I am directing DPC to include this note to the ADAMS package and to declare and replicate as publicly available, the ADAMS package and all documents within the package.
