APPROVAL OF CIMARRON ENVIRONMENTAL RESPONSE TRUST PROPOSED 2019 BUDGET, REVISION 1 FOR THE CIMARRON FACILITY IN CRESCENT, OKLAHOMA

Dear Mr. Halliburton:

By letter dated November 21, 2018, the Cimarron Environmental Response Trust (CERT) submitted its Proposed 2019 Budget Revision 0 (Agency wide Documents Access and Management System (ADAMS) Accession No. ML19029A122) totaling $5,185,311. The U.S.

Nuclear Regulatory Commission (NRC) staff reviewed this submittal and by letter dated March 20, 2019 (ADAMS Accession No. ML19029A683), specifically questioned the necessity of treatability testing included in Task 4 for Decommissioning Support, at a cost of $166,000, as treatability testing had already been conducted in 2018. After further evaluation, CERT determined that there was no need to conduct additional treatability testing since the material used in 2018 (Dowex 1) is made of the same material as new proposed material (Dowex 21).

By letter dated April 1, 2019, CERT submitted Proposed 2019 Budget, Revision 1 (ADAMS Accession No. ML19107A336) which deleted the $166,000 for treatability testing discussed above. In addition, CERT also noted that the Revision 0 budget had erroneously used an old rate schedule, and that the Revision 1 budget changed the billing rates to Environmental Property Managements current billing rates. This added $29,712 to the Revision 1 budget, resulting in a net reduction in the budget of $136,288.

Further, the NRC notes that activities 8 and 9 of the budget include installation of trenches and wells, which are proposals still under NRC review as part of the Cimarron Facility Decommissioning Plan (DP) (ADAMS Accession No. ML18323A197). Therefore, CERT may not commence these activities unless and until the NRC approves the DP.

Finally, the NRCs approval of these activities in the budget does not constitute approval to re-allocate these portions of the budget to other activities without prior written approval from Oklahoma Department of Environmental Quality and the NRC. With this caveat, the NRC staff approves the Cimarron Proposed 2019 Budget, Revision 1, dated April 1, 2019, for $5,049,023.
