Dear Mr. Feyrer:
This is in regard to your letter dated March 20, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML19081A122), providing a description of changes made to the Physical Security Plan (PSP) for the Vallecitos Nuclear Center (VNC, Docket Number 05000073, License Number R-33; Docket Number 07000754, License Number SNM-960) in Sunol, CA. In your submittal you stated that the changes have been internally reviewed by the VNC and documented as those that do not decrease the plans effectiveness and, therefore, not requiring prior U.S. Nuclear Regulatory Commission (NRC) approval in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Paragraphs 50.54(p)(2) and 70.32(e).
Since these regulations allow licensees to make changes to their PSPs without prior NRC approval provided that the changes do not reduce the effectiveness of the plan, NRC internal procedures require that these changes be reviewed during an inspection for final determination and/or appropriate action. As such, the NRC staff is referring the changes to the NRC Region IV inspection staff for follow-up, as appropriate.
In accordance with 10 CFR Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this communication will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS.
