REVIEW OF SUPPLEMENTAL STANDARDS APPLICATIONS FOR U.S.

HIGHWAY 191 AND HISTORICAL HIGHWAY RIGHTS-OF-WAY

Dear Mr. McCallister:

By letter dated November 21, 2016, the U.S. Department of Energy (DOE) requested U.S.

Nuclear Regulatory Commission (NRC) concurrence on application of supplemental standards for the historical highway in the Utah Department of Transportation (UDOT) right-of-way that underlies the portion of the North Moab Canyon Recreation Trail on the DOEs Moab site (Agencywide Documents Access and Management System (ADAMS) Accession Number ML16309A037). By letter dated July 31, 2017, DOE also requested that NRC concur on the application of supplemental standards for certain portions of U.S. Highway 191 rights-of-way.1 (ADAMS Accession Number ML17227A237). Application of supplemental standards are allowed under Title 10 of the Code of Federal Regulations (10 CFR), Part 40.192, provided that certain circumstances related to soil cleanup are met.

Based on the review of the information provided, the NRC concurs that the application of supplemental standards for both the U.S Highway 191 rights-of-way and historical highway right-of-way. A technical evaluation report documenting the review of the two areas is enclosed.
