Louisiana Energy Services, LLC NRC Docket Number: 70-3103 UUSA Comments on Proposed Rule: Revision Fee Schedules FRN 2019-00219 The Nuclear Regulatory Commission ("NRC") published the subject draft guide on January 31, 2019 requesting comments. In response, Louisiana Energy Services, LLC, dba URENCO USA (UUSA) submitted comments on 03/04/2019. As allowed in the Reference, UUSA's comments in Enclosure 1 were submitted via the website http://www.regulations.gov.

UUSA has been participating in the fee schedule and recovery rulemaking closely as the changes impact UUSA's continual challenges to remain profitable in a strained market. UUSA appreciates the NRC's efforts in considering these comments and asks the staff to continue the efforts exhibited to reduce the overall fee burden of the fuel cycle industry overall.

On January 31, 2019, the NRC issued proposed rule Docket ID NRC-2017-0032, Revision to Fee'*>"-,

Schedules, Fee Recovery for 2019. Louisiana Energy Services, dba, URENCO USA (UUSA), herewith submits comments on the proposed fee schedule for 2019. Specifically, UUSA's comments directly\\_~

relate to the Table 2 below from NRC FY 2019 Proposed Fee Rule Work Papers (ML18361A780).

The effort factor for Uranium Enrichment is presently a 10 for Solid UF6/Metal. The effort factor for Category 1 Fuel Fabricators is also a 10 and is a 5 for Category 3 Fuel Fabricators and conversion facilities. UUSA does not agree that a 10 fairly represents the level of NRC activities conducted for UUSA. The number of inspections, vintage of the design and license, simplicity and number of process systems, and IROFS demonstrates that the assigned factor in comparison to the other fuel cycle facilities should be lower than that assigned to Fuel Fabricators. The value assigned has been in place for ten years and was assigned before UUSA went into operation. The value was assigned at the same level of other operating enrichment facilities at the time which were all. gaseous diffusion plants. The comparison is shown between Table 1 below (ML18361A780) and Table 2.

There is not a justification for why UUSA's safety factor for, Solid UF6/Metal for Safety, should be higher than Category 3 Fuel Fabricators and is more appropriately reflected as a 1.

UUSA appreciates the NRC's efforts in considering these comments and asks the staff to continue the efforts exhibited to reduce the overall fee burden of the fuel cycle industry overall.
