QUALITY ASSURANCE PROGRAM APPROVAL FOR RADIOACTIVE MATERIAL PACKAGES NO. 0017, REVISION 7

Dear Dr. Goodwin:

By letter dated August 31, 2018, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18243A134) the Rhode Island Atomic Energy Commission submitted an application for approval of the Quality Assurance (QA) program, Revision 7 under Title 10 Code of Federal Regulations (10 CFR) Part 71. The request is for approval of the Rhode Island Nuclear Science Centers (RINSC) QA program to support shipping of Materials Test Reactor low-enriched uranium type reactor fuel and other packages containing Type B quantities of special nuclear material under the 10 CFR Part 71 general license provisions.

By letter dated December 26, 2018 (ADAMS Accession No. ML18361A645), the Nuclear Regulatory Commission Staff (NRC) staff sent a request for additional information (RAI) to RINSC to support the staffs review of the QA program, Revision 7. RINSC provided supplemental information by letter dated January 7, 2019 (ADAMS Accession No. ML19007A267). The staff has reviewed these submittals and noted that the changes associated with this revision are not considered reduction of commitments in the QA program previously approved by the NRC. Hence, no further information or action is needed at this time.

Please refer to previous NRC correspondence dated August 12, 2015 (ADAMS Accession No. ML15225A493), informing you that 10 CFR 71.38 has been amended to remove the requirements for renewal of QAP Approvals, and that 10 CFR 71.106 was added to establish requirements that will apply to changes to QAPs.

The new regulations in 10 CFR 71.106 require QAP Approval holders to receive NRC Approval before implementing changes to their QAP that will reduce their commitments to the NRC. In addition, changes to your QAP that do not reduce commitments must be submitted to the NRC every 24-months, with the reporting period starting on the date your revised Form 311 was approved. Please note that if you did not make any changes to your QAP in the preceding 24-month period, you are required to report that no changes were made. If you wish to amend your QAP Approval and have determined it reduces commitments, or terminate this Approval, please request it in writing.
