OF SEPTEMBER 20, 2018, CLOSED MEETING WITH THE U.S. NUCLEAR REGULATORY COMMISSION STAFF AND OKLO, INC., TO DISCUSS OKLO, INC., DRAFT PRINCIPAL DESIGN CRITERIA REPORT On September 20, 2018, a closed meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives from Oklo, Inc. (Oklo) at the NRC offices at One White Flint North, 11555 Rockville Pike, North Bethesda, Maryland 20852, Room 10-B04. The purpose of this closed meeting was for Oklo personnel to engage the NRC on details of the Draft Principal Design Criteria Report.
NRC provided Oklo with feedback on the Draft Principal Design Criteria Report. Much of the discussion focused on features of the Oklo design that are used to contain radionuclides, remove heat, and control reactivity. Oklo used the advanced reactor design criteria (ARDC) as the starting point for developing their principal design criteria (PDC). The NRC staff noted that in general, there was not enough information about the Oklo design available to comment on the applicability of Oklos proposed PDC. In some cases Oklo asserted that an ARDC was not applicable. The staff noted that many of the ARDCs were written using language like if needed or when required to encompass situations where a structure, system, or component may not be needed for safety, thus these ARDCs could be applicable to Oklo. The staff also noted that much of the report contained public information and requested that Oklo provide a portion marked version of the report in accordance with 10 CFR 2.390. The NRC provided Oklo a Oklo PDC Report Comments matrix table for discussion during the meeting.
On October 11, 2018 Oklo verbally requested to withdraw the Draft Principal Design Criteria Report. The NRC considered this request and responded to Oklo in a letter dated January 8, 2019. The letter stated that Oklo could withdraw the Draft Principal Design Criteria Report pursuant to, 10 CFR 2.390 (c)(3), however, the Oklo PDC Report Comments matrix that NRC staff provided to Oklo would be retained by the NRC as it is subject to the Federal Records Act and to future Freedom of Information Act (FOIA) requests. Oklo responded to the NRCs letter on January 23, 2019 and provided a both public and non-public version of the NRC staffs PDC Report Comments matrix along with a request to withdraw the Draft Principal Design Criteria Report.
