January 7, 2019 Post Fukushima Order Implementation Status Mitigating Strategies (MS) Order (EA-12-049) Compliance Status

- As of June 18, 2018, all operating power reactor units are in compliance with Order EA-12-049.

- The NRC staff performs inspections in accordance with NRC Inspection Manual Temporary Instruction 2515/191 (TI-191) after all units at a site are in compliance to verify that required FLEX equipment and connections are in place.

- The staff has completed TI-191 inspections at 57 sites.

Spent Fuel Pool Instrumentation (SFPI) Order (EA-12-051) Compliance Status

- As of June 30, 2017, all operating power reactor units are in compliance with Order EA-12-051.

- The NRC staff inspects for compliance with the SFPI Order in conjunction with the inspections for Order EA-12-049.

Severe Accident Capable Hardened Containment Vent System (HCVS) Order (EA-13-109) Compliance Status

- Order EA-13-109 established a schedule for 30 applicable licensees (boiling water reactors with Mark I or Mark II containments) to achieve full compliance with Phase 1 (wetwell vent) by June 30, 2018 and full compliance with Phase 2 (drywell vent or a strategy that makes drywell venting unlikely) by June 30, 2019.

- One unit has been granted an extension to the required compliance date until after the planned final shutdown date. This unit has an operable hardened vent in place providing compensatory measures.

- The NRC approved withdrawal of the order for Oyster Creek Nuclear Generating Station on December 14, 2018.

- As of December 28, 2018, 28 applicable reactor units are in compliance with Phase 1, and 24 applicable reactor units are in compliance with Phase 2.

- The NRC staff will perform inspections for compliance with the HCVS Order in accordance with NRC Inspection Manual Temporary Instruction 2515/193 (TI-193) after all units at a site are in compliance.

- A pilot TI-193 inspection was completed at Dresden on July 28, 2018.

A table with the Order Compliance Status is provided on the following page. Site names that are highlighted in dark green have completed all post-Fukushima activities and the NRC has issued a completion letter. The NRC approved relaxation/withdrawal of the three orders for Oyster Creek Nuclear Generating Station on December 14, 2018. Oyster Creek has permanently shutdown and certified that all fuel has been permanently removed from the reactor.
