PROPOSED RADIOACTIVE MATERIALS RULE FOR VERMONT AGREEMENT
Dear Senator MacDonald:
In a July 6, 2015, letter to then Chairman Stephen Burns of the U.S. Nuclear Regulatory Commission (NRC), Governor Peter Shumlin of the State of Vermont stated that Vermont intended to pursue an Agreement with the NRC to assume regulatory authority over certain byproduct material, source material, and small quantities of special nuclear material.
Section 274b. of the Atomic Energy Act of 1954, as amended (the Act), authorizes the Commission to enter into an Agreement with the Governor of a State providing for the discontinuance of the regulatory authority of the Commission with respect to certain materials.
The NRC currently licenses the use of these radioactive materials in the State of Vermont at academic, medical, industrial, and commercial facilities.
It is our understanding that your Committee will be considering the proposed Radioactive Materials Rule from the Vermont Department of Health (VDH). These rules are an essential part of the State of Vermonts proposed regulatory program for an Agreement with the NRC.
We want to let you know for over the last 14 months, the NRC has reviewed and provided feedback to VDH regarding the proposed Radioactive Materials Rule. We have determined that the proposed Radioactive Materials Rule is compatible with NRCs regulatory and statutory requirements with the incorporation of our comments detailed in our last letter to VDH on October 4, 2018 (ML18270A214) and without other significant change.
