SUBJECT:

SAFETY EVALUATION REPORT: AMENDMENT 3 - NEW RADIATION SAFETY OFFICER I. INTRODUCTION By letter dated October 3, 2018, Sensor Concepts & Applications, Inc. submitted a License Amendment Request (LAR) for changes to its application. Specifically, the change requested approval of a new radiation safety officer (RSO). The letter is available in the Agencywide Documents Access and Management System (ADAMS) under Accession Number ML18278A003.

II. DISCUSSION The regulation in Title 10 of the Code of Federal Regulations (10 CFR) Paragraph 70.23(a) states that an application for a license will be approved if the Commission determines, in part, that the applicant is qualified by reason of training and experience to use licensed material for the purpose requested. The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed the training and experience of the proposed RSO against the minimum qualification requirements in the original application ADAMS Accession Number ML113000464 dated August 18, 2010 and finds them acceptable. Specifically, the NRC staff makes the following findings:

The prospective RSO is identified as Mr. Benjamin D. Lewis. Mr. Lewis has completed Radiation Safety Officer Training as prescribed in the original application and cited in the Safety Evaluation Report issued December 27, 2011 (ADAMS ML113080787). The report documents that RSO training will be consistent with the RSO training requirements of NUREG-1556, Volume 4, Revision 1, Consolidated Guidance About Material License, Program-Specific Guidance About Fixed Gauge Licenses (ADAMS ML16188A048). In addition, Mr. Lewis completed Authorized User Training, described in Chapter 8.7 of the NUREG, in November 2017. Mr. Lewiss training record was submitted as a part of the LAR. Mr. Lewis has functioned as the Assistant RSO since June of 2016. Appendix D of NUREG-1556, Vol. 4, Revision 1 describes the course content and experience requirements for the RSO. The staff finds the qualifications of the new RSO to be acceptable.

III. ENVIRONMENTAL REVIEW A proposed action is excluded from an environmental review under 10 CFR 51.22(c)(14)(v) if it is an amendment to a license issued pursuant to 10 CFR Part 70 authorizing the use of radioactive materials for research and development and for educational purposes. The changes to the LAR meet this requirement.

The NRC staff determined that the proposed action does not adversely impact public health and safety or the environment, and is categorically excluded from the requirement to conduct an environmental review. Therefore, in accordance with 10 CFR 51.22(c)(14)(v), neither an environmental assessment nor an environmental impact statement is warranted for this action.
