NORTH CAROLINA STATE UNIVERSITY - ACKNOWLEDGEMENT OF WITHDRAWAL OF LICENSE AMENDMENT REQUESTS REGARDING FUELED EXPERIMENTS FOR THE PULSTAR RESEARCH REACTOR (EPID NO. L-2018-LLA-0247)

Dear Dr. Hawari:

By letter dated August 27, 2018 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18241A135), North Carolina State University (NCSU) submitted a license amendment request (LAR) for the NCSU PULSTAR research reactor. NCSU requested the amendment to revise its license conditions (LCs) and technical specifications (TSs) to allow it to increase the quantity of uranium-235 (U-235) in fueled experiments; to allow it to perform fueled experiments with neptunium-237 or plutonium-239, in addition to U-235; and to allow it to perform vented fueled experiments. The amendment would also make other changes related to fueled experiments, including revising the TS definition of fueled experiment, and increasing license possession limits for fissile and fissionable materials to be used in fueled experiments.

NCSU stated that the amendment would allow the LCs and TSs to accommodate its planned experimental needs.

By letter dated October 3, 2018 (ADAMS Accession No. ML18263A235), the U.S. Nuclear Regulatory Commission (NRC) staff stated that it had performed an acceptance review of NCSUs LAR, and determined that supplemental information was necessary to make the LAR complete. The NRC staff requested that NCSU either 1) supplement the LAR by November 5, 2018, or 2) withdraw and resubmit the LAR at a later date. By electronic mail dated November 2, 2018 (ADAMS Accession No. ML18318A375), NCSU notified the NRC staff that the supplemental information requested in the NRC staffs October 3, 2018, letter would not be submitted by the November 5, 2018, deadline. Subsequently, by letter dated November 9, 2018 (ADAMS Accession No. ML18319A091), NCSU notified the NRC staff that it was withdrawing its August 27, 2018, LAR, and that it planned to submit a new LAR for fueled experiments in the near future.

In its November 9, 2018, letter, NCSU also stated that it was withdrawing earlier fueled experiment LAR submittals dated February 13, 2013 (ADAMS Accession No. ML13085A400),

January 12, 2017 (ADAMS Accession No. ML17013A398), and August 22, 2017 (ADAMS Accession No. ML17237A205), confirming NCSUs statements that it was withdrawing earlier fueled experiment LAR submittals in an electronic mail dated September 18, 2018 (ADAMS

Accession No. ML18261A271). The NRC staff notes that NCSUs January 12, 2017, and August 22, 2017, submittals were supplements to NCSUs previous fueled experiment LAR dated February 13, 2013.

Based on the information discussed above, the NRC staff has terminated its reviews of NCSUs LAR dated August 27, 2018, as well as NCSUs previous LAR dated February 13, 2013, and supplemented on January 12, 2017, and August 22, 2017. However, information provided to the NRC staff in support of these LARs will remain in ADAMS.
