ORDER FOR IMPLEMENTATION OF ADDITIONAL SECURITY MEASURES AND FINGERPRINTING FOR UNESCORTED ACCESS FOR CERTAIN SPENT FUEL STORAGE LICENSEES - KEWAUNEE NUCLEAR GENERATING STATION INDEPENDENT SPENT FUEL STORAGE INSTALLATION EA-07-195

Dear Mr. LaPrade:

By letter dated January 28, 2008 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML080910518), the Nuclear Regulatory Commission (NRC) issued an Order (EA-07-195), "Order for Implementation of Additional Security Measures and Fingerprinting for Unescorted Access to Certain Spent Fuel Storage Licensees (the Order). of the Order contained access authorization and fingerprinting requirements for the Kewaunee Power Station (KPS) Independent Spent Fuel Storage Installation (ISFSI). By letter dated February 15, 2008 (ADAMS Accession No. ML14255A003), Dominion Energy Kewaunee, Inc. (DEK) consented to the Order and provided its response to the Additional Security Measures (ASMs) for Access Authorization and Fingerprinting at ISFSIs in Attachment

2. On October 15, 2015, (ADAMS Accession No. ML15294A073) you revised DEK's answer to the Order to reflect an ISFSI using dry storage that is not collocated with an operating power reactor facility and requested relaxation of Attachment 2 to the Order.

, section A.2 of EA-07-195 states: Licensees whose ISFSI is collocated with a power reactor may choose to comply with the NRC-approved reactor access authorization program for the associated reactor as an alternative means to satisfy the provisions of Sections B through G, below. Otherwise, licensees shall comply with the access authorization and fingerprinting requirements of Section B through G of these ASMs (emphasis added). The purpose of this letter is to respond to your request for relaxation and to clarify what is meant by an ISFSI collated with a power reactor.

For the purposes of EA-07-195, the condition collocated with a power reactor, was intended to be an initiating condition that presumed the existence of a 10 CFR Part 73 access authorization program for the associated reactor, not that the ISFSI must always remain collocated with a power reactor. For the case where the reactor is to be decommissioned and eventually released from the license, the continuation of the access authorization program that was acceptable for the power reactor is also considered acceptable for the ISFSI. Therefore, the

relief you requested is unnecessary for your facility, even if the power reactor is decommissioned and removed, as long as the access authorization program is maintained, consistent with what would be required for a power reactor under 10 CFR Part 73. Based on the above, your request for relaxation of Attachment 2 to EA-07-195 is not granted.

In accordance with Title 10 of the Code of Federal Regulations section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
