UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 November 8, 2018 Mr. Paul Schmidt Chief, Radiation Protection Section Wisconsin Division of Public Health 1 Wilson Street PO Box 2659 Madison, WI 53701-2659

Dear Mr. Schmidt:

We have reviewed the final revisions to the Wisconsin regulations, Wisconsin DHS 157 Radiation Protection, received by our office on September 13, 2018. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2011-1, 2011-2, 2012-1, 2012-2, 2012-3, 2012-4, 2013-1, 2013-2, 2015-3, 2015-4, and 2015-5 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with Mark Paulson of your staff on November 6, 2018.

As a result of our review, we have no comments that are related to compatibility; however we have noted two editorial comments in the attached table. Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that the regulations, as adopted, meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

The SRS Data Sheet summarizes our knowledge of the status of other Wisconsin regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. This letter, including the SRS Data Sheet, is posted on the NMSS State Communication Portal: https://scp.nrc.gov/rulemaking.html.

P. Schmidt If you have any questions regarding the review results, the compatibility and health and safety categories, or any of the NRC regulations used in the review, please contact Michelle Beardsley, State Regulation Review Coordinator, at (301) 415-0275, (Michelle.Beardsley@nrc.gov), or Darren Piccirilo at (630) 829-9661 (Darren.Piccirillo@nrc.gov).

Sincerely,

/RA Paul Michalak for/
