WYOMING INSPECTION PLANNING
Dear Mr. Schierman:
This letter is in regard to your inquiry related to the timing of next inspections for the 14 licenses to be transferred to the State of Wyoming on September 30,, 2018. Enclosed is a table that lists the 14 licenses and the due dates for each license based on last U. S. Nuclear Regulatory Commission (NRC) inspection conducted at the facility.
Requirements with regard to inspection frequencies can be found in Inspection Manual Chapter (IMC) 2801, Uranium Mill 11e. (2) Byproduct Material Disposal Site and Facility, and IMC 2641, In-Situ Leach Facilities Inspection Program. Inspection for operating facilities should be conducted every 6-12 months1 and inspections for facilities undergoing decommissioning are every 24 months2. Guidance in Office of Nuclear Material Safety and Safeguards Procedure SA-110, Reviewing the Non-Common Performance Indicator, Uranium Recovery Program indicates that Agreement States will not be penalized for failing to meet internally developed inspection schedules that are more aggressive than those specified in IMC 2801 and IMC 2641, or current NRC policy. Additionally, it states that those inspections considered overdue should be tallied consistently (i.e., inspections more than 25 percent late than the minimum frequency specified in IMC 2801 and IMC 2641 will be considered overdue).
1 NRC Manual Chapter 2641, In-situ Leach Facilities Inspection Program, dated August 25, 2000, states that the normal frequency for (most) inspection procedures is 6 months, with a minimum inspection frequency of 12 months.
Extensions of inspection intervals can be implemented based on good licensee performance. Based on MC 2641 criteria, RIV made the decision to inspect these some licensees, as noted on the attached table, on an annual basis.
