Dear Mr. Smith:
We have reviewed the final revisions to the Mississippi State Department of Health regulations Title 15, Part 21, Subpart 78 Radiological Health, received by our office on August 21, 2018.
These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules in 10 CFR Parts 19, 20, 30, 31, 32, 33, 34, 35, 36, 39, 40, 70, 71, and 150 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on October 22, 2018.
As a result of our review, we have three comments that have been identified in the enclosure.
Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.
We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Mississippi, in response to our comments, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Mississippi regulations, as indicated. COMPATIBILITY COMMENTS ON MISSISSIPPI FINAL REGULATIONS STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS 1 1.1.2 20.1003 10 CFR 20 Various Definitions - General Comment 1.4.1 Mississippi adopts by reference 10 CFR 20.1103 in Rule 1.4.1 which includes all Part 20 definitions.
However, in Rule 1.1.2 Mississippi has its own set of definitions some of which are redundant and are not identical to NRCs definitions in Part 20 which are being adopted by reference, e.g., the definitions of Monitoring, Background Radiation, and Restricted Area which are A matters of compatibility. This causes conflict and could cause confusion as to which definition applies.
Mississippi should either ensure that the definitions in 1.1.2 are compatible with the definitions they are adopting by reference in Part 20, or delete the redundant definitions in order to meet various Compatibility Category designations assigned to 10 CFR Part 20, Definitions.
2 1.7.1 35.2 10 CFR 35 B Definitions - Radiation Safety 1.1.2.(95) Officer Mississippis definition of Radiation Safety Officer in Rule 1.1.2.(95) is not essentially identical to the NRCs definition in 10 CFR Part 35.2.
Mississippi needs to rewrite the definition in Rule 1.1.2.(95) to be essentially identical to the language as stated in Part 35.2 in order to meet the Compatibility Category B designation assigned to 10 CFR 35.2, Definition of Radiation Safety Officer.

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS 3 N/A 35.3204 10 CFR 35 A Report and notification for an eluate exceeding permissible molybdenum-99, strontium-82, and strontium-85 Mississippi did not address 10 CFR 35.3204 in their rules submittal. This is a new regulation that was added in the recently published final Part 35 rule (83 FR 33406), and is part of RATS ID 2018-1 which is due for State adoption in January 2022.
Mississippi can either adopt this regulation by reference at this time, or submit it by the adoption due date.
Mississippi can submit the above regulation for review in order to meet the Compatibility Category C designation assigned to 10 CFR 35.3204.
