INCORPORATION OF TRAVELER TSTF-565, REVISION 1, REVISE THE LCO 3.0.2 AND LCO 3.0.3 BASES INTO THE NEXT REVISION OF THE STANDARD TECHNICAL SPECIFICATIONS
Dear Members of the Technical Specifications Task Force:
By letter dated March 30, 2018 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18089A064), the Technical Specifications Task Force (TSTF) submitted to the U.S. Nuclear Regulatory Commission (NRC) Traveler TSTF-565, Revision 1, Revise the [Limiting Condition for Operation] LCO 3.0.2 and LCO 3.0.3 Bases. You requested that the NRC review the traveler for incorporation into the next revision of the Standard Technical Specifications (STS).
The proposed change deletes the term operational convenience from the STS Bases of LCO 3.0.2 and LCO 3.0.3 and in part replaces it with a reference to Title 10 of the Code of Federal Regulations (10 CFR) Section 50.65, Requirements for Monitoring the Effectiveness of Maintenance at Nuclear Power Plants (the Maintenance Rule) criteria. Traveler TSTF-565, Revision 1, is applicable to the Bases of the STS for all reactor designs.1 The NRC staff acknowledges the term operational convenience in the current Bases of STS LCO 3.0.2 and LCO 3.0.3 is not a requirement imposed by regulation or the TS.

As described in Generic Letter 87-092 and in the decision by the Director, Office of Nuclear Reactor Regulation in the matter of Arizona Public Service Company,3 the intended purpose of LCO 3.0.3 is to provide time limits for an orderly shutdown when individual LCOs and/or action statements in other specifications are not met. The proposed Bases language recognizes the fact that STS are silent as to the reason, intentional or otherwise, that an LCO is not met.
The proposed STS Bases for LCO 3.0.3 in Traveler TSTF-565, Revision 1, continue to discourage but not prohibit voluntary removal of redundant systems or components from service. The revised bases include the following: Planned entry into LCO 3.0.3 should be avoided. If it is not practicable to avoid planned entry into LCO 3.0.3, plant risk should be assessed and managed in accordance with 10 CFR 50.65(a)(4). Therefore, when an intentional entry is made, provisions in the Maintenance Rule provide a defined process to assess and manage any increase in risk that may result from such intentional entry. In addition, TS Actions provide necessary and appropriate measures given the LCO conditions, to maintain the plant in a safe condition.
The NRC staff considered the proposed changes to the STS Bases against the requirements for TS Bases in 10 CFR 50.36 and Section IV, The Commission Policy, of the Final Policy Statement on Technical Specifications Improvements for Nuclear Power Reactors, published in the Federal Register on July 22, 1993 (58 FR 39132). The proposed changes to the STS Bases accurately reflect the reason and purpose for LCO 3.0.2 and LCO 3.0.3, and now align more closely with the Commissions Final Policy Statement. Additionally, the NRC plans to incorporate this traveler in the next revision of the STS.
