NPDES No. AL0022080 This is in response to your July 13, 1977, letter concerning.tIte operation.

of Browns Perry Nuclear Plant, Alab,mats Water Quality Standards, and the recently issued NPDPS Pexmit.

Your letter also transmitted a copy of the petition for an adjudicatory hearing submitted to EPA seeking less stringent thermal effluent limitations.

This request has been prompted by the poor performance of the cooling towers as well as structural failure of one tower and a concern that a similar failure may occur in other towers.

Xn a letter dated July 15, 1977, Region XV of EPA. stayed the contested provisions of the.NPDES Permit until a decision is made to either grant or deny the request for an adjudicatory heaxing.

However, EPA went further and granted.your xequest,for,relief concexning.,water quality standards and imposed temporary discharge conditions.

These conditi'ons specify that you willnot exceed a maximum temperature limit of 90OP nor a maximum temperature rise of 5OP, both as measured at the downstream edge of the a"signed mixing zone.

TVA has previously supplied tbis. office with. environmental assessments that.

addxess the thermal dischaxge from he plant and the ixtpact on a balanced indigenous population of fish and aquatic life.

We understand tha't you axe asking for concurrence'with EPA's position based on this previously supplied information.

We further understand that TVAwillupdate this= information by August 15, 1977, and determine what actions willbe taken to rectify the existing situation concerning the cooling 'system.

We axe of the opinion that the position taken by EPA is a reasonable one in view of the existing information, and the critical need for this facility.

The technical. staff of the WXC, therefoxe,.concurs. with,that position.
