REQUESTS FOR WITHHOLDING OF EPRI MOV PERFORMANCE PREDICTION PROGRAM: ADDENDUM 10 TO EPRI 103237-R2: PPM VERSION 4.0 SOFTWARE CHANGES (EPID: L-2018-TOP-0035)

Dear Mr. Riti:

By letter dated August 30, 2018 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18255A242), the Nuclear Energy Institute submitted a letter and affidavit both dated August 8, 2018, executed by Mr. Neil Wilmshurst, Vice President and Chief Nuclear Officer of the Electric Power Research Institute (EPRI). The affidavit requested that the information contained in the following document be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations, Part 2, Section 2.390 (10 CFR 2.930).

"EPRI MOV [Motor-Operated Valve] Performance Prediction Program: Addendum 10 to EPRI 103237-R2: PPM [Performance-Prediction Model] Version 4.0 Software Changes."

A non-proprietary version of the documents can be found under the previously referenced ADAMS Accession number.

The NRC staff has reviewed the application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, has determined that the submitted information sought contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure under 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, the agency may send copies of this information to its consultants working in this area. The NRC staff will of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC staff.

In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
