THE OHIO STATE UNIVERSITY - NON-ACCEPTANCE OF AMENDMENT REQUEST WITH OPPORTUNITY TO SUPPLEMENT FOR THE RENEWED FACILITY OPERATING LICENSE NO. R-75 (EPID NO. L-2018-LLA-0231)

Dear Dr. Cao:

By letter dated August 27, 2018 (Agencywide Documents Access and Management System Accession No. ML18242A075), the Ohio State University (OSU) submitted a license amendment request (LAR) for the OSU Research Reactor (OSURR). The proposed LAR would modify the technical specifications (TSs) to address OSURRs exhaust fan speed rate and would change the restricted area definition in the current version of the TSs.

The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of the LAR. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the LAR has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the facility.

Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an amendment to the license (including the TSs) must fully describe the changes requested, and follow as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The NRC staff requests that you supplement the application to address the information requested in the enclosure within 15 days from the date of this letter. This will enable the NRC staff to begin its detailed technical review. If the information responsive to the NRC staffs request is not received by the above date, the application will not be accepted for review pursuant to Section 2.101 of 10 CFR, and the NRC staff will cease its review activities associated with the application. If the application is subsequently accepted for review, you will be advised of any further information needed to support the NRC staffs detailed technical review by separate correspondence.

1) Provide technical justifications for the proposed change to remove the reference of the exhaust fan flow rate in the technical specification (TS) 3.5. Provide detailed analysis on the conclusions, e.g., radioactive waste release and dose consequence and etc. that were drawn to determinde reactor would operate safely based on 1,000 cubic feet per minute flow rate calculations.
2) Provide the copies of the proposed TSs pages in word form, directly to your facility project manager for processing, with vertical bars to the right side to indicate the changes to the current TSs. These pages will be used to replace your current TSs pages when the license amendment request is approved by the NRC.
