Dear Mr. PeterW G
Pursuant to Section 309 of the Clean Air Act, the Environmental Protection Agency has reviewed the final environmental impact, statement filed by the Atomic Energy Commission on May 16, 1973, regarding the proposed licensing of Shearon Harris Nuclear Power Plant, Units 1, 2, 3, and 4.
The final statement supports licensing of the Shearon Harris plant with once-through cooling of the thermal effluent discharging to a 10,400 acre lake system.
This lake system would be formed by impounding Buckhorn 'Creek, a navigable waterway of the "State of North Carolina to which Pederally-approved water quality standards-apply.
I am writing to inform you of EPA's views on this proposed action.
EPA has, assessed that the project, as proposed, would violate water quality standards and would be inconsistent with the intent and provisions of the Federal Water Pollution Control Act Amendments of 1972.
Accordingly, I have made a
determination required by Section 309 of the Clean Air Act that tne project, as described in the final environmental impact statement, is unsatisfactory from the standpoint. of environmental quality.
I have communicated this finding to, the Atomic Energy Commission, and hereby refer the, issue-to
.;'".',;::.,:",'.=;,'he Council on Environmental Quality.
Discussions have beeri held. between my staff and repre-sentatives of the Commission and CEQ to discuss alternatives that would, be satisfactory from the standpoint of environmental quality and water quality protection.
ln this regard, EPA suggested.
in a letter of July 10, 1973, to the State of North Carolina that the proposed Shearon Harris plant be equipped with off-stream, closed-cycle, evaporative cooling
- with an impoundment of some 3000-4000 acres for make-up water storage.
The applicant has agreed to such a change and has proposed installation of cooling towers with a 4000 acre impoundment.
This alternative is currently under study by the Atomic Energy Commission and. would, in our view, be environmentally acceptable.
