Dear Mr. Muntzing:
On December 14, 1973, Carolina Power I'E Light Company submitted a request to perform certain site prepaxation and related activities prior to the issuance of construction permits in accordance with 10 CFR 50.12(a) of the Atomic Energy Commission Regulations.
On January 4
and 6, 1974, Mr. Gordon K. Dicker, Chief, Environmental Projects Branch 2, verbally requested additional information concerning this exemp-tion request.
The following responses were submitted verbally to Mr. Dicker on January 7, 1974.
What is the status of land acquisition for the total Shearon Harris Project2 Answer 1:
The total project will require 10,744 acres as shown on PSAR Figure 2.l-lb.
9,376 acres have been acquired to date.
. Of the 1,368 acres remaining, negotiations are proceeding.
There will be a few instances in which condemnation will be required.
Condemnation proceedings on some parcels have been initiated.
In summary, CP&L acquisition of land required for the Shearon Harris Pxoject is sufficiently advanced to provide no impediment to the construction activities specified in the exemption request.

Define the status of acquisition of land which will be involved in work performed under the required exemption.
Answer 2:
The response below addresses each activity requested for exemption individually.
Tem orar facilities Item a:
CP&L owns all land which will be involved in building and improving roads as well as the land for borrow areas included in the exemption request.
Item b:
CP&L owns all land which will be involved in these plant site related activities.
Item c:
CP&L owns the land on which the concrete production plant will be erected.
Permanent facilities Item a:
CP&L owns all the land involved in clearing, grading and foundation excavation for the plant.
Item b:
CP&L owns all the land involved in clearing, earth and track work for temporary relocation of the Norfolk & Southern Branch Line.
A small fraction of the land required for.,the relocation of the Norfolk & Southern main line has not yet been acquired.
Negotiations are well advanced and expect to be satisfactorily concluded shortly.
Item c:
CP&L owns the entire auxiliary reservoir area.
Approximately
'welve per cent of the main reservoir area is still in the process of being acquired.
As noted in our request for exemption, clearing of the main and auxiliary reservoirs will be only partially completed during the exemption period.
.Although acquisition of the remaining tracts in the project area is proceeding, the progress of this clearing. activity will not be dependent on acquisition of the remaining land during the exemption period.

The activities to be performed under this exemption are not irreversible or irrevocable; and should Carolina Power
& Light Company be denied a Construction Permit for the Shearon Harris Nuclear Power Plant, those areas effected by activities authorized under an exemption would be restored or the site will be utilized for the construction of a fossil Hied steam electric plant.
ln the latter case, any areas previously affected during exemption-authorized activities and not needed for the fossil fired plant would be restored appropriately.
On January 8, 1974, Mr. Dicker verbally requested Carolina Power
& Light Company to also provide information concerning the area that would be cleared in the reservoirs during the exemption period.
Answer 6:
Carolina Power
& Light Company expects to clear no more than 1000 acres in the two reservoir areas during the exemption period, and this would comprise less than 15% of the total reservoir area required for power generation.
