SUBJECT:
PUBLIC MEETING BETWEEN THE NUCLEAR REGULATORY COMMISSION AND EXELON GENERATION COMPANY, LLC REGARDING PRE-SUBMITTAL OF A LICENSE TRANSFER APPLICATION TO HOLTEC INTERNATIONAL FOR OYSTER CREEK NUCLEAR GENERATING STATION On August 15, 2018, a public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of the Exelon Generation Company, LLC (Exelon) at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland.
The purpose of the meeting was for NRC and Exelon to discuss the pre-submittal of a license transfer application for the sale of Oyster Creek Nuclear Generating Station (Oyster Creek) to Holtec International (Holtec).
On August 3, 2018 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML18215A420), a meeting noticed was issued. The meeting notice also contained the meeting agenda.
The meeting was kicked off at 1:00 p.m. with opening remarks by the NRC staff followed by a roll call of the attendees. The list of attendees is provided in the Enclosure.
By letter dated January 7, 2011 (ADAMS Accession No. ML110070507), Exelon notified the NRC of its certification to permanently cease power operations at Oyster Creek no later than December 31, 2019, pursuant to Section 50.82(a)(1)(i) of Title 10 of the Code of Federal Regulations ( 10 CFR).
By letter dated February 14, 2018 (ADAMS Accession No. ML18045A084), Exelon revised its certification to permanently cease power operations at Oyster Creek no later than October 31, 2018, pursuant to 10 CFR 50.82(a)(1)(i).
On July 29, 2018, Holtec announced an agreement between Holtec and Exelon for the purchase of Oyster Creek from Exelon. Under the terms of the agreement, which is subject to regulatory approvals, Holtec will assume ownership of the site, real property and used nuclear fuel. As the site's owner, Holtec will manage all site decommissioning and restoration activities.
Holtec plans to decommission Oyster Creek in 8 years. Exelon's plan was to take up to 60 years to decommission Oyster Creek. The Exelon/Holtec staff provided a presentation (ADAMS Accession No. ML18226A002).
Exelon stated that approximately 450 people are currently employed at Oyster Creek. Exelon plans to permanently cease power operations for Oyster Creek in September 2018. Exelon submitted the Oyster Creek Post-Shutdown Decommissioning Activities Report (PSDAR) by letter dated May 21, 2018 (ADAMS Accession No. ML18141A775). Exelon selected SAFSTOR as a decommissioning strategy for Oyster Creek. In accordance with 10 CFR 50.82(a)(3),
decommissioning will be completed within 60 years of permanent cessation of operations. If the license transfer of Oyster Creek from Exelon to Holtec does not get approved, Exelon will maintain the SAFSTOR decommissioning strategy for Oyster Creek.
The current Exelon plan has the following timeframes:
- March 2020: December 2073: Dormancy,
- March 2024: All fuel moved to Independent Storage Fuel Storage Installation,
- June 2076: Large component removal complete,
- December 2077: Plant systems removal and building decontamination complete,
- September 2078: License termination, and
- April 2080: Site restoration.
Holtec presented information regarding the company and its partners, parent companies, subsidiaries, and joint ventures.
Holtec explained its financial strength. Holtec discussed the company, SNC-Lavalin, as well as the company, Atkins. Holtec talked about the Holtec team, including the joint venture by Holtec and SNC-Lavalin known as Comprehensive Decommissioning International (CDI). CDI is a decommissioning general contractor. The company that would own Oyster Creek if the license transfer is approved is known as Oyster Creek Environmental Protection, LLC (OCEP).
Holtec would select DEGON as a decommissioning strategy for Oyster Creek if the license transfer is approved.
The Holtec plan has the following timeframes:
- 2019 - 2021: All fuel moved to ISFSI,
- 2021 - 2027: Plant systems removal and building decontamination complete,
- 2027 - 2033: ISFSI operations,
- 2033 - 2034: Fuel removed from site, and
- 2034 - 2035: License termination.
Holtec described the decommissioning organization structure.
Holtec plans to submit the following:
- License with Exelon on August 17, 2018,
- The revised PSDAR and decommissioning cost estimate update in early September 2018,
- The revised spent fuel management plan in early September 2018,
- Exemption request to use decommissioning trust funds for spent fuel management and site restoration in early September 2018, and
- License transfer submittal requesting approval no later than May 2019.
The NRC staff asked questions regarding the finances, foreign ownership, decommissioning trust fund (DTF), company structure, OCEP, the potential licensed owner; Holtec Decommissioning International, LLC, the potential licensed operator; contingency plans if assumptions change; regulatory approvals needed; and the State of New Jersey Administrative Consent Order.
The members of the public had questions regarding 2012 corruption charges and World Bank disbarment for SNC-Lavalin; the company structures and the limited liability corporations and should the public be concerned about having to pay for decommissioning; concerns about zirconium fire in the spent fuel pool; protections for the DTF; indemnity insurance; quality assurance; the dry cask design being able to be kept cool; clarification of the licensed owner, licensed operator, and the submittal date for the license transfer; and clarification that Exelon would not own the spent fuel after the license transfer, if approved. The NRC staff addressed the questions.
At this meeting, the NRC staff made no regulatory decisions regarding the merits of the proposed license transfer for Oyster Creek.
The meeting was adjourned at 2:45 p.m.
