I received your letter of October 20, which is attached, after the close of business yesterday.

Florida Power 6 Light Company will object to any effort to "lodge" evidentiary material with the Commission or the Licensing Board in any of the proceedings which are now pending before the NRC. None of the proceedings referenced in the caption to your letter are at, a stage where evidence would properly be received. ?moreover, even if evidentiary proceedings were in progress, evidentiary material would'properly be sponsored by sworn witnesses, not "lodged" through a pleading.

I request that, if you decide nonetheless to file such a motion, the motion be filed without. its being accompanied by the material in question, so that the Commission or Licensing Board may decide whether to receive the material without being presented with a fait accompli.
