Dear Mr. Thompson:

By letter dated, May 7, 2018, Alliant Techsystems (ATK) Operations, LLC submitted to the U.S. Nuclear Regulatory Commission (NRC) a Request for Consent to Indirect License Transfer of NRC Material License Number 24-24576-01.

Based on the information provided, we understand that the indirect license transfer will result from a sale between Orbital ATK and Northrop Grumman Corporation.

Alliant Techsystems (ATK) Operations, LLC is currently a wholly-owned subsidiary of Orbital ATK. Upon closing of the transaction Orbital ATK will continue as a surviving corporation and a wholly-owned subsidiary of Northrop Grumman

  • Corporation.

After the transaction the parent company Orbital ATK will change its name to Northrop Grumman Innovation Systems, Inc. We further understand that this transfer did not result in any change to the licensee name, licensed materials, persons using licensed material, location of use, facilities or equipment, or persons responsible for Alliant Techsystems (ATK) Operations, LLC's Radiation Safety Program. Based on the above understandings and as more fully detailed in the enclosed NRC staff's Safety Evaluation Report which documents the NRC staff's review of the request, the NRC consents to the indirect transfer of control. It is requested that notification of the change of control be provided to the NRC within 30 days of the effective transaction date. The transferee, Northrop Grumman Corporation, should note their new responsibility and liability as an NRC licensee.

Specifically, responsibility is emphasized with regard to any ongoing NRC inspection and enforcement issues, investigations, facility decontamination and decommissioning funding resources.

Please be advised, change of ownership/control cannot be transferred without prior written consent from the NRC (10 CFR 30.34 (b)). A copy of this regulation may be found on the NRC website at collections/cfr/part030/part030-0034.html.

You will be periodically inspected by NRC. Failure to conduct your program in accordance with NRC regulations, license conditions, and representations made in your license application and supplemental correspondence with NRC will result in enforcement action against you. This could include issuance of a notice of violation, or imposition of a civil penalty, or an order suspending, R. Thompson modifying or revoking your license as specified in the General Statement of Policy and Procedure for NRC Enforcement Actions. Since serious consequences to employees and the public can result from failure to comply with NRC requirements, prompt and vigorous enforcement action will be taken when dealing with licensees who do not achieve the necessary meticulous attention to detail and the high standard of compliance which NRC expects of its licensees.

While a policy statement and not a regulation, it sets forth the agency's expectations for individuals and organizations to establish and maintain a positive safety culture. We strongly encourage you to review this material and adapt it to your particular needs in order to develop and maintain a positive safety culture as you engage in NRC-regulated activities.
