Regan: >I AP~ This is in response to your request of April 14, 1975 for comments on the draft environmental statement (J""S) related to constructioa of Palo Verde nuclear Generating Station Units 1, 2, and 3, Arizona. Pursuant to i,ts responsibilities under Section 102(2) (C) of the iNational Envixonmental Policy Act of 1969, the Advisory Council has determined that the DES appears adequat concerning compliance with the pxovisions of Section 106 of the >>iational Historic Preservation Act of 1966. However, with respect to evi-dence of compliance with the pxovisions of Executive Order 11593 "Protect on and Enhancement of the Cultural Environment" of i~fay 13, 1971, the Council notes tnat cultural surveys of the entire project area have been underta'e'en or programed and further "that mitigating measures aopropriate to any newly discovered resource and the character of the construction. will be ta'ken." "he Council wishes to remind the ~~tuclear Regulatory Commission'thaL should these surveys locate and identify cultuxal resources which are determined, eligible for inclusion in the National Register of Historic Places which w.'ll be affected by the undertaking, prior to initiating any activity, including i~lementation of mitigative measures, it must afford the Council an opoortunity to connnent. For your nfoxmation, steps to determine eligi-bility, effect and to obtain Council comments are detailed in the "Procedures zor the Protection of Historic and Cultural Properties" (36 C.F-R.
