'The Advisory Council has received nB~~e ed the final environmental statement (FES) for the Palo Verde Generating Station, Units 1, 2, and 3, Arizona.
We note from our review that the United States Nuclear Regulatory Commission.
(NRC) has not satisfactorily addressed our comments of May 2,, 1975 concerning compliance with Executive Order 11593, "Protection and Enhancement of the Cultural Environment" of May 13, 1971 with respect to this proposed undertaking.
We note further that the undertaking as proposed will result in effects to cultural resources which have been determined or may be eligible for inclusion in the National Register of Historic 'Places.,
Therefore, NRC is required to comply with the Executive Order'1593 as implemented through the "Procedures for the Protection of Historic and Cultural Properties" (36 C.F.R. Part 800).
In order to expedite the compliance process, the Council requests that pursuant to Section 800.4(a)(2) of the procedures NRC request an opinion from the Secretary of the Interior respecting the eligibility for inclusion in the National Register of those properties identified in the FES as being affected by the undertaking and for which some form of'itigation measures have been recommended and inform us of the findings.
Should the Secretary of the Interior determine these properties are eligible for inclusion in the National Register, then NRC should follow the remaining steps set forth in Section 800.4 to evaluate the nature of the effect and afford the Council an opportunity to comment as appropriate.
In addition, the NRC should evaluate the effect and afford the Council an opportunity to comment as appropriate with respect to the Skunk Creek and New River Dams Archeological Districts as well as Archeological Site No. Arizona T:4:6 (Arizona State University),
properties previously determined eligible for inclusion in the National Register by the Secretary of the Interior.
The Council is an indePendcnt unit of'he Executive Branch of the Federal Governnscnt charged by the Act of October If, 1966 to advise 'the President and Congressin thc field of Historic Preservation.

Until the requirements of the Executive Order 11593 and the procedures are met, the Council considers the FES to be incomplete in its treatment of the archeological, historical,, architectural and cultural resources.
To remedy this deficiency, the Council willprovide substantive comments on the undertaking's-effect upon the above cited cultural resources through the process detailed in the procedures.,
