Dear Mr. Regan:

This is to acknowledge your letter of November',

1975 transmitting a copy of supplement f/6 to the Palo Verde Nuclear Generating Station Units 1, 2 and 3, Arizona, environmental report.

Receipt of the document prompted a review'f Advisory Council files'hich indicated we have not received' response to our letter'f October 9th '(copy enclosed) which requested'dditional i'nformation on the"proposed undertaking.

In that letter we noted that: the proposed undertaking may effect several cultural resources which may be eligible for inclusion in the National Register of Historic Places as well.as three properties which have been determined'o be eligible for inclusion in the National Register by the Secretary of the Interior.

We further. requested'hat the Nuclear Regulatory Commission seek determinations of eligibility'or the former sites, and if subsequently determined eligible for inclusion in the National Register by the Secretary of the Interior, to follow the remaining steps set forth in Section 800.4 of the "Procedures for the Protection of Historic and Cultural Properties" (36'.F.R. Part 800) to evaluate the effect of the undertaking upon all identified cultural resources and'btain the Council's comments as appropriate in compliance with Executive Order 11593,.'Protection and Enhancement of the Cultural Environment" of May 13, 1971'.

The Advisory Council has received and xeviewed the final environmental statement (FPA) for the Pal.o.Verde Generating'tation, Units 1, 2, and 3, Arizona.

Pe note from our review that the United States Nuclear Regulatory Commission (HRC) has not satisfactorily addressed our comments of Hay 2, 1975 concerning compliance with Executive Order 11593, "Protection and Enhancement of the Cultural Environment" of Ywy 13, 1971 with respect to this,proposed undertaking.

Pe note further that the undertaking as proposed willxesult in effects to cultur'al resources which have been determined or may be eligible for inclusion in the National Register of Historic Places.

Therefore, HRC is required to comply with the Executive Order 11593 as implemented through the "Procedures for the Protection of Historic and Cultural Properties" (36 C.P R. Part 800).

In order to expedite the compliance process, the Council requests that pursuant to Section 800.4(a)(2) of the procedures HRC request an opinion from the Secretary of the Interior respecting the oligibi&.tyfor inclusion in the National Resister of those properties identified in the PES as being affected by the undertaking and for which st form of mitigation measures have been recommended and inform us of thc findings.

Should the Secretary of the Interior determine these properties are eligible for inclusion in the National agister, then HRC should follow the remaining steps set forth in Section 800.4 to evaluate the nature of the effect and afford the Council an opportunity to comment as appropriate-In addition, the NRC shou1d evaluate the effect and afford the Council an opportunity to corm+at as appropriate with respect to the Skuld Cree!c and Hew River Dans Archeological Districts as weU.

Until the requirements of the Executive Order 11593 and the procedures are met, the Council considers the PES to be incomplete in its treatment of the archeological, historical, architectural and cultural resources.

To remedy this deficiency, the Council will provide substantive comments on the undertaking's effect upon the above cited cultural resources through the process detailed in the procedures.
