Dear Mr. Varga:
In an effort to respond to NRC requests for information in the reference concerning hydroge'n recombiners and to expedite the licensing review in this area, we are transmitting to you with this letter four (4) copies each of Air Products and Chemicals, Inc.
reports APCI-78-6 and APCI-78-6P. The latter report is considered proprietary by ourselves and Air Products and as such it is requested that this information be withheld from public disclosure.
Per 10CFR2.790 an affidavit justifying this request accompanies each proprietary copy.
The reports address full-scale performance testing, catalyst testing, and seismic, IEEE and mechanical design qualification.
It is our hope that this information in conjunction with face-to-face discussion will allow the NRC to perform a detailed review of this area and allow reasonably prompt notification to us of additional testing or information required. Due to our construc-tion schedule, the need for any additional testing must be identi-fied prior to August 15, 1978. We stand ready to support you in

I am general manager of the Advanced Products Department of Air Products and Chemicals, Inc. ("Air Products" ). I have been delegated the function of reviewing the information described in Paragragh 2 which is sought to .
be withheld and have been authorized to apply for its withholding, pursuant to 10 CFR 2, Paragraph 2.790.
- 2. The information sought to be withheld consists of the following:
Air Products'eport No. APCI-78-6P, Proprietary Supplement to Report No. APCI-78-6: ,"Air Products'ost LOCA Recombiner Test Summary".
- 3. The above described material consists of confidential commercial information and trade secrets within the meaning of 10 CFR 2, Paragraph 2.790 (a) (4). Air Products continuously develops which it regards as proprietary and confidential and' informa-,'ion valuable trade secret of the Corporation. Such information is utilized by Air Products in conducting its business and a disclosure of such information would seriously erode the Corporation's ability to compete in the market-place. Information that fits into this category includes, by way of illustration only, such items as:
- a. Detailed process design parameters.
- b. Design and manufacturing data for APCI proprietary equipment.
- c. Test reports resulting from internally funded R 8 D or engineering studies.
- d. Manufacturing cost data.
- e. Customer lists.
- f. Contracted confidential research.
All such information whether preliminary or final, utilized by Air Products in conducting its business, is treated as confidential by Air Products and not to be disclosed to third parties unless such third parties are under an obligation of confidentiality to Air Products. After a project, task, or defined milestone is reached, the cognizant technical manger wi 11 review the data generated to see if it can be released generally or shall continue to be maintained as confidential. The cognizant technical manager is generally familiar with the art to which the information pertains and can preliminarily evaluate its value to the Corporation and whether or not such information is available generally to the industry.

- 4. The information sought to be withheld has been evaluated and a deter-mination has been made that it contains information which should be held confidential and proprietary by Air Products in the normal course of its business and, therefore, this information has been transmitted to the Commission in confidence. Public disclosure of the information sought to be withheld from disclosure would in all likelihood cause substantial harm,to the competitive position of Air Products and deprive or reduce the availability of profit-making opportunities since this information would:
- a. Provide competitors with a privileged knowledge and understanding of the detailed technical design and performance parameters of Air Products'roprietary Catalytic Post LOCA Recombiner System, and
- b. Provide competitors with a detailed understanding of research, development, and engineering data developed as part of an independent, internally funded Air Products'rogram.
