Title:

PUBLIC MEETING TO DISCUSS THE NRCS RETROSPECTIVE REVIEW OF ADMINISTRATIVE REQUIREMENTS Meeting Identifier: 18135A088 Date of Meeting: May 31, 2018 Location: U.S. Nuclear Regulatory Commission Three White Flint North, 3WFN-01C03 11601 Landsdown Street North Bethesda, MD 20852 Type of Meeting: Category 3 Purpose of the Meeting(s): The purpose of the meeting was to provide an opportunity for the Nuclear Regulatory Commission (NRC) staff and external stakeholders to exchange information regarding the retrospective review action plan and the draft criteria to be used in the NRCs Retrospective Review of Administrative Requirements (RROAR) initiative.

General Details: This meeting provided an opportunity for the NRC staff to present and discuss the retrospective review action plan and draft criteria to facilitate submittal of public comments. The retrospective review action plan and draft selection criteria were noticed in the Federal Register (83 FR 19464), and are available for review and public comment until July 2, 2018.

The meeting was attended by 29 individuals including industry representatives, members of the public, and NRC staff. Thirteen individuals participated on the Webinar and teleconference.

Summary of Presentations: The meeting slides and handouts are available in the Agencywide Document Access and Management System (ADAMS) package under Accession No. ML18170A331. In addition to the material presented in the slides, the major areas of discussion are summarized below.

Public Participation Themes:

Overview of the Retrospective Review of Administrative Requirements (RROAR) Initiative The NRC staff presented an overview of the RROAR initiative including a description of the objective, scope, process, and timeline. The presentation was followed by a question and answer session. One area of discussion was the timeline of the initiative. The NRC staff discussed the steps outlined in the Federal Register notice and communicated that the goal is to provide recommendations to the Commission within 18-24 months of the staff requirements memorandum to SECY-17-0119, Retrospective Review of Administrative Regulations, dated April 5, 2018 (ADAMS Accession No. ML18096A553).

Draft Evaluation Criteria The NRC staff provided a presentation about the draft evaluation criteria to be used in the RROAR initiative. The presentation was followed by a question and answer session.

The presentation highlighted questions asked in the Federal Register notice about topics on which the NRC staff is requesting specific feedback from the public. One topic is the evaluation criterion about regulatory changes that may result in a significant reduction in burden. The NRC staff noted a particular interest in public feedback about the magnitude of a quantitative threshold, any data that would provide a basis for establishing such a threshold, and whether or not multiple thresholds should be considered for different licensee classes.

Another topic is the criterion on third-party information collections. The NRC staff encouraged the public to provide comments on the scope of this criterion.

Action Items/Next Steps:

The NRC staff closed the meeting with a discussion of next steps, as listed below.

  • The public comment period for the Federal Register notice closes on July 2, 2018.
  • The public is encouraged to submit comments using any method described in the Federal Register notice. The preferred method is electronic comment submission using www.regulations.gov (NRC Docket ID NRC-2017-0214), but the NRC staff will consider all public comments submitted on the docket.
