Items of Interest Week Ending June 8, 2018 Clarification of Export Reporting Requirements for Nuclear Facilities, Equipment, and Non-Nuclear Materials: Draft Regulatory Issue Summary; Request for Comment; Chapter 1 of Title 10 of the Code of Federal Regulations (NRC-2018-0113)

On June 8, 2018, the NRC published a document in the Federal Register (83 FR 26611) requesting public comment on a draft regulatory issue summary to clarify the reporting requirements for certain exports of nuclear facilities, equipment, and non-nuclear materials.

Comments are due by August 7, 2018.

Office of Nuclear Reactor Regulation (NRR)

Items of Interest Week Ending June 8, 2018 Differing Professional Opinion Regarding Operator Licensing Examinations On April 27, 2018, the Acting Director, Office of Nuclear Reactor Regulation (NRR), issued a decision on a Differing Professional Opinion (DPO) submitted on October 10, 2017, involving operator licensing written examinations. The DPO raised concerns that the recent policy determination made by NRR staff for writing and assessing Tier 1 written examination test items has the potential to undermine the 10 CFR 55.41 that the written examination contain a representative selection of questions on the knowledge, skills, and abilities needed to perform licensed operator duties. The Panel made three recommendations to help clarify guidance to the staff. The Acting Director, NRR, agreed with the Panel on the recommendations. Differing Professional Opinion Regarding Radiological Impact of the Removal of the Auxiliary Shield Blocks On May 8, 2018, the Acting Director, NRR, issued a decision on a DPO submitted on October 24, 2017, involving radiological impact of the removal of the auxiliary shield blocks on the containment accident shield post large break loss of coolant accident. The DPO raised concerns that a memo issued by the Deputy Director of the Division of Operating Reactor Licensing, NRR, to the Deputy Director of the Division of Reactor Safety, Region III, stated that the licensee is not required to limit the dose to occupational workers in non-vital areas during design basis accidents. There is no regulation related to radiation exposure that would require restoration of the accident missile blocks or installation of equivalent shielding. The Panel made three recommendations to help clarify guidance to the staff. The Acting Director, NRR, agreed with the Panel on the recommendations. Turkey Point Units 3 and 4 Government Environmental Review Meeting On May 29, 2018, the staff held a government-to-government meeting with several Federal, State, and local agencies, including the U.S. National Park Service, Miami-Dade County, and the U.S. Environmental Protection Agency, regarding the NRC environmental review of Florida Power & Light Companys subsequent license renewal application for Turkey Point Nuclear Units 3 and 4. During the meeting, the staff provided an overview of the environmental and safety reviews for subsequent license renewal, and participants provided helpful feedback regarding local environmental concerns and methods to increase coordination among other Federal, State, and local agencies. The staff intends to follow-up with a technical interagency meeting in June.

Turkey Point Units 3 and 4 Environmental Scoping Meetings On May 31, 2018, the staff held two public scoping meetings in Homestead, Florida, to support the NRC environmental review of the subsequent license renewal application for Turkey Point Nuclear Units 3 and 4. The purpose of the meetings was to provide to the public an overview of the staffs license renewal review process and to receive public comments regarding important environmental issues that the staff should consider. The public comments will be transcribed and placed on the record for the staff to consider in preparing for its environmental review of the application.
