By [[letter::L-2010-101, Comment (1) of Larry Nicholson, on Behalf of Florida Power & Light Co., on Proposed NUREG-0800, Standard Review Plan for the Review of Safety Analysis Reports for Nuclear Power Plants; Branch Technical Position (BTP) 7-19, Guidance for .|letter dated May 25, 2010]], NextEra Energy Seabrook, LLC, submitted an application pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 51 and 10 CFR Part 54, to renew the operating license NPF-86 for Seabrook Station, for review by the U.S. Nuclear Regulatory Commission (NRC or the staff). The staff is reviewing the information contained in the license renewal application and has identified, in the enclosure, areas where additional information is needed to complete the review.

REQUESTS FOR ADDITIONAL INFORMATION RELATED TO SEABROOK STATION, UNIT NO. 1 LICENSE RENEWAL APPLICATION ENVIRONMENTAL REVIEW
Background:
As a Federal agency, the U.S. Nuclear Regulatory Commission (NRC) must comply with the Endangered Species Act of 1973, as amended (16 United States Code (U.S.C.) § 1531 et seq.)
(ESA), as part of any action authorized, funded, or carried out by the agency, such as the proposed issuance of a renewed operating license for Seabrook Station, Unit No. 1 (Seabrook).
Under section 7 of the ESA, the NRC must consult with the U.S. Fish and Wildlife Service (FWS) and the National Marine Fisheries Service (NMFS), as appropriate, to ensure that the proposed agency action is not likely to jeopardize the continued existence of any endangered or threatened species or result in the destruction or adverse modification of designated critical habitat.
Issue:
In 2014 and 2015, the FWS published final rules (79 FR 73706; 80 FR 17974) listing the rufa red knot (Calidris canatus rufa) and the northern long-eared bat (Myotis septentrionalis) as threatened under the ESA. The two species ranges include Rockingham County, New Hampshire, in which Seabrook is located. Accordingly, the NRC staff intends to address potential effects to these species as part of its license renewal review. The NRC staff requests the following information to assist in its review.
Requests:
Northern Long-Eared Bat
- 1. Provide any information that NextEra Energy Seabrook, LLC (NextEra) has regarding the northern long-eared bats use of the Seabrook site. Such information may include potential habitat (particularly summer roosting habitat) or other uses of the site by the species, observations of the species on the site, and studies or monitoring performed to document potential presence of the species on the site. The FWSs final rule describes northern long-eared bat habitat in detail.
- 2. Has NextEra observed any injured or dead bats (of any species) on the site, especially near the base of tall buildings and structures? If so, please describe these occurrences and include the date(s) of observation, species (if known), condition of individual(s), suspected cause of injury or mortality, and any follow-up actions that NextEra took as a result of the incident(s).
- 3. Is NextEra aware of any bat injuries or mortalities resulting from collisions with motor vehicles on the Seabrook site? If so, please describe these occurrences and include the date(s) of observation, species (if known), condition of individual(s), and any follow-up actions that NextEra took as a result of the incident(s).
- 4. Describe the procedures or protocols that NextEra maintains, if any, to ensure that effects to federally listed bats are appropriately considered prior to site activities, such as tree
removal, landscape maintenance, or other operational activities that could directly or indirectly affect bats.
- 5. Is NextEra aware of any studies, monitoring, or other reports involving the northern long-eared bat on or in the vicinity of the Seabrook site? If so, please list and provide short summaries of each. Such studies, monitoring, or reports may have been performed by NextEra, its contractors, other private entities, Federal or State agencies, non-profit groups, educational or scientific institutions, etc.
Rufa Red Knot
- 6. Provide any information that NextEra has regarding the rufa red knots use of the Seabrook site. Such information may include the presence of suitable migratory stopover habitat on the site, observations of the species on the site, and studies or monitoring performed to document potential presence of the species on the site. The FWSs final rule describes rufa red knot habitat in detail.
- 7. Has NextEra observed any injured or dead red knot individuals on the site, especially near the base of tall buildings and structures? If so, please describe these occurrences and include the date(s) of observation, species (if known), condition of individual(s), suspected cause of injury or mortality, and any follow-up actions that NextEra took as a result of the incident(s).
- 8. Is NextEra aware of any red knot injuries or mortalities resulting from collisions with motor vehicles on the Seabrook site? If so, please describe these occurrences and include the date(s) of observation, species (if known), condition of individual(s), and any follow-up actions that NextEra took as a result of the incident(s).
- 9. Describe the procedures or protocols that NextEra maintains, if any, to ensure that effects to federally listed red knots are appropriately considered prior to site activities, such as landscape maintenance and operational activities or other work within wetland and coastal areas that could directly or indirectly affect red knots.
- 10. Is NextEra aware of any studies, monitoring, or other reports involving the rufa red knot on or in the vicinity of the Seabrook site? If so, please list and provide short summaries of each. Such studies, monitoring, or reports may have been performed by NextEra, its contractors, other private entities, Federal or State agencies, non-profit groups, educational or scientific institutions, etc.
Piping Plover and Roseate Tern
- 11. The NRC staff previously consulted with the FWS regarding the piping plover (Charadrius melodus) and the roseate tern (Sterna dougalli dougalli) during the staffs environmental review of the Seabrook license renewal application. In a letter dated September 1, 2010 (ADAMS Accession No. ML102630180), the FWS concluded that the proposed license renewal of Seabrook is not likely to adversely affect either species. Is NextEra aware of any new information that could indicate effects on these species that have not been previously addressed and that may require the staffs further coordination or reinitiated consultation with the FWS?
