- NOTICE OF ENFORCEMENT DISCRETION FOR VIRGINIA ELECTRIC AND POWER COMPANY REGARDING SURRY UNIT 2 By letter dated May 3, 1993, you requested the U. S. Nuclear Regulatory Commission (NRC) to exercise its discretion not to enforce compliance with the required actions in Technical Specification (TS) 3.1.A.3.a.

You informe~ the NRC on April 30, 1993, at 3:40 p.m., that Surry Unit 2 would not be in compliance with TS 3.1.A.3.a regarding the operability of three pressurizer safety valves when the Unit 2 head was on the reactor vessel and the reactor coolant average temperature was greater than 350 degrees Fahrenheit.

You stated that this condition would exist for a period not to exceed 36 hours4.166667e-4 days <br />0.01 hours <br />5.952381e-5 weeks <br />1.3698e-5 months <br /> commencing at 9:00 p.m., on April 30, 1993, and ending on 9:00 a.m., on May 2, 1993.

You provided as justification for continued operation that the events that could potentially challenge the Reactor Coolant System boundary are a heat addition transient and a mass addition transient.

You identified the following administrative controls to prevent these transients. These will be established when the A and C safety valves are mechanically secured for hydrostatic testing or when attempting to reseat the valves:

1)

The reactor will remain subcritical with all rods fully inserted and Reactor Coolant System boron concentration maintained greater than 2100 ppm.

2)

One ~ewer operated relief valve will be operable with the associated block valve open and at a minimum, the second power operated relief valve will be available for manual operation with the associated block valve open.

3)

One or more reactor coolant pumps will be in operation with the loop stop valves open.

4)

High head safety injection pump surveillance testing will not be performed when the safety valves are mechanically secured.

has been provided to the plant op~rations staff to.address Reactor Coolant System pressure and temperature during this evolution.

Based on our review of your justification, including any compensatory measures (administrative controls) identified above, we have concluded that this course of action involves minimum or no safety impact, and ~e are clearly satisfied that this exerci~e of enforcement discretion-is warranted from a public health and safety perspective. Therefore, it is our intention to exercise discretion not to enforce compliance with TS 3.1.A.1.a for the period from 9:00 p.m.

April 30, 1993, to 9:00 a.m., May 2, 1993.

However, we will consider enforce-ment action, as appropriate, for the conditions that led to the need for this exercise of enforcement discretion.
