NOTICE OF ENFORCEMENT DISCRETION FOR VIRGINIA ELECTRIC AND POWER COMPANY REGARDING SURRY POWER STATION, UNIT 2 (TAC M86326}

By letter dated May 4, 1993, you requested the U.S. Nuclear Regulatory Commission (NRC} to exercise its discretion not to enforce compliance with Technical Specifications (TS} Sections 3.12.F.l and 2.3.A.2.(b}.

You informed the NRC staff on May 4, 1993, that the Surry Power Station, Unit 2 would not be in compliance with the minimum allowable reactor coolant system (RCS}

operating pressure of 2205 psig specified in TS 3.12.F.l and TS 2.3.A.2 {b},

  • which currently requires the high pressurizer presstire reactor trip setp6int to be less than or equal to 2385 psig to provide protection against reactor coolant system overpressure events.

You stated that the "A" pressurizer safety valve exhibited minor leakage past the valve disc with the RCS pressure at the normal operating pressure of 2235 psig but became stable at an RCS pressure of 2135 psig.

In your May 4, 1993, submittal you requested an enforcement discretion from the requirements of TS 3.12.F.l and 2.3.A.2.(b} to permit power operation at a reduced RCS nominal operating pressure of 2135 psig to preclude leakage through the "A" safety valve until the NRC has processed an emergency TS amendment in response to a request which you are scheduled to submit by May 6, 1993.

If approved, the TS amendment would reviie the minimum allowable operating pressure from 2205 psig to 2105 psig and would revise the high pressurizer pressure reactor trip setpoint from equal to or less than 2385 psig, to equal to or less than 2310 psig and permit operation at these conditions for the duration of Cycle 12.

In addition, you informed us that you would reduce the PORV setpoints by 100 psi as a compensatory measure.

You provided as justification. for your request the results of your reanalysis using the proposed TS values, in which you concluded that operation of Surry, Unit 2 will maintain the existing accident analysis margins and ensure the RCS pressure will be maintained at less than 110 percent of design accident condit i ans.

Mr. Stewart May 6, 1993 Based on our review of your justification, including the compensatory measure identified above, we have concluded that this course of action involves minimum or no safety impact, and we are clearly satisfied that this exercise of enforcement discretion is warranted from a public health and safety perspective. Therefore, this letter confirms our verbal approval of your request on May 4, 1993, and our intention to exercise discretion not to enforce compliance with TS Sections 3.12.F.l and 2.A.3.2.(b) until we complete processing of an emergency Technical Specification request.

However, we will consider enforcement action, as appropriate, for the condttions that led to the need for this exercise of enforcement discretion.
