PROPOSED IMPOSITION OF CIVIL PENALTIES - $125,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of $125,000 will be issued on or about October 21, 1991 to Virginia Electric Power Co.
This action is based on two violations each of which is being issued with a proposed civil penalty.
The first violation involves the inoperability of EOG No. 3 which is co11111on to both units. Improper maintenance and failure to perform adequate post-maintenance testing resulted in the EOG being unable to automatically assume emergency electrical loads if required to do so. The second violation involves the operation, over an extended period of time, of the charging pumps in an electrical configuration in which manual actions would be required, in some scenarios, to ensure high pressure safety injection flow.
Both violations were classified at Severity Level III. After considering the escalation/mitigation factors of the enforcement policy the base civil penalty of $50,000 for the first violation was increased 50% for the licensee's initially inadequate corrective actions.
For the second violation no adjustment of the base civil penalty was made after offsetting escalation for prior notice with mitigation for corrective actions.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice Telephone Notification of Licensee October 21, 1991 October 21, 1991 The Commonwealth of Virginia will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
