PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civi.l Penalty in the amount of $50,000 will be issued on or about February 13, 1991 to Virginia Electric and Power Company.

J)e-s is based on the licensee's failure to maintain the recirculation spray heat exchangers operable. Mitigation of the ~ase civil penalty by 50% was appropriate for the licensee's prompt and extensive.corrective action.
However, it was offset by the 50% escalation of the base civil penalty that was appropriate for prior notice. Therefore, on balance the $50,000 base civil. penalty is proposed.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice Telephone Notification of Licensee The State of Virginia will be notified.
February 13, 1991 February 13, 1991 The licensee has thirty.days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may.be remitted, mitigated, or imposed by Order.
