U.S. DEPARTMENT OF LABOR COMPLAINT On May 15, 1990, the U.S. Department of Labor's Wage and Hour Division in Richmond, Virginia, received a complaint from a former employee of Omni Services, Inc., a contractor at the Surry Nuclear Station. The former employee alleged that he was dismissed from his employment because he had raised safety concerns while performing his duties at the Surry Nuclear Station.
In response to that complaint, the Wage and Hour Division secured an employee/employer conciliation on May 30, 1990, and the Settlement Agreement which resulted from the conciliation was signed by Mr. J. Scott Robinson, a Virginia Electric and Power Company representative.
The NRC is concerned that a violation of the employee protection provisions set forth in 10 CFR 50.7 may have occurred and that the actions taken against the former employee may have had a chilling effect on other licensee or contractor employees.
Therefore, you are requested to provide this office, within 30 days of the date of this letter, a response which:
- 1.
Provides the basis for the employment action regarding the former employee and includes a copy of any investigation reports you have regarding the circumstances of the action; and
- 2.
Describes the actions, if any taken or planned to assure that this employ-ment action does not have a chilling effect in discouraging other licensee or contractor employees from raising perceived safety concerns.
Should you not have any investigation reports regarding the circumstances of the action, you are requested to initiate an investigation to establish the facts and circumstances of the matter.
During your investigation, particular attention should be given to the former employee's written complaint which has been previously provided by DOL to Mr. Robinson.
After reviewing your response, the NRC wi 11 determine whether enforcement action is necessary at this time to ensure compliance with regulatory require-ments.
In accordance with 10 CFR 2.790 of the NRC's 11Rules of Practice, 11 a copy of this letter and its enclosure will be placed in the NRC Public Document Room *
