(NRC INSPECTION REPORT NOS. 50-280/94-32 AND 50-281/94-32}
Gentlemen:
This refers to a special inspection conducted by M. Branch of this office on
October 27 to November 14, 1994.
The inspection included a review of
activities authorized for your Surry facility. At the conclusion of the
inspection, the findings were discussed with Mr. R. Saunders and other members *
of your staff identified in the enclosed report.
Areas examined during the inspection are described in the report. Within
these areas, the inspection consisted of selective examinations of procedures
and representative records, interviews with personnel, and observation of
activities in progress.
Based on the results of this inspection, certain of your activities appear to
be in violation of NRC requirements, as specified in the enclosed Notice of
Vio.lation (Notice}.
The violation is of concern because ineffective.*
communication and management, along with a failure to escalate a degrading
trend, resulted in operation with a degraded 2A station battery.
Your
organization was slow to identify and initiate effective corrective actions to
repair the degraded 2A station battery.
On four separate occasions, members
of your staff had information indicating a cell of the 2A station battery did
not meet the operability criteria specified in station procedures. This
information was available as early as October 7, 1994, but was not acted upon
by your staff until October 27, 1994.
On October 28, 1994, a Notice of
Enforcement Discretion was verbally granted by the NRC with written
confirmation on October 31, 1994 to allow time to complete corrective actions.
This violation is of particular concern since it is similar to a recent
violation associated with the timely identification of and corrective actions
for the degraded auxiliary ventilation filters (NRC Inspection Report
Nos. 50-280/94-24 and 50-281/94-24}. Recurring violations are of particular
concern because the NRC expects licensees to learn from their past failures
and to take effective corrective actions. Although the NRC does not normally
consider monetary civil penalties for Severity Level IV violations, the
Enforcement Policy states that such penalties may be imposed for Severity
Level IV violations that are similar to previous violations for which the
licensee did not take effective corrective action.

decided not to hold an enforcement conference nor to propose a civil penalty
because this violation was of minor safety significance.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when.preparing youi response.
In your
response, you should document the specific actions taken and any additional
actions you plan to prevent recurrence.
In particular, we expect you to
address the untimely/ineffective corrective actions that allowed this issue to
occur. After reviewing your response to this Notice, including your proposed
corrective actions and the results of future inspections, the NRC will
determine whether further NRC enforcement action is necessary to ensure
compliance with NRC regulatory requirements.
The responses directed by this letter and the enclosed Notice are not subject
to the clearance procedures of the Office of Management and Budget as required
by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.
Pursuant to 10 CFR 2.790 of the NRC's "Rules of Practice", a copy of this
letter and its enclosures will be placed in the NRC Public Document Room.
Accordingly, your response should not, to the extent possible, include any
personal privacy, proprietary, or safeguards information so that it can be
released to the public and placed in the NRC Public Document Room.
