Wigginton At the request of Virginia Electric and Power Company (VEPCO), a meeting on May 6, 1985, was held in Bethesda, MD between the NRC and VEPCO, Duquesne Light Company and Northeast Utilities regarding respiratory protection for subatmospheric containments. Subatmospheric containments contain a lower partial pressure of oxygen than an atmosphere at standard temperature and pressure (STP), thus requiring the use of self-contained breathing apparatuses when entry into containment is necessary. Certain breathing apparatuses are not NIOSH/MSHA certified for use with enriched oxygen.

10 CFR 20.103(e) prohibits the use of equipment of a particular type which has not been tested and certified, or had certification extended, by NIOSH/

MSHA, or where there is no existing schedule for test and certification of certain equipment, without specific authorization by the Commission.

10 CFR 20.103(f) prohibits equipment not certified by NIOSH/MSHA to be used as emergency devices.

During the May 6, 1985 meeting, VEPCO stated that, in the short term, they would develop and submit a testing protocol for NRC's assessment.

It was also indicated that all of the participating licensees intended to demonstrate that seven years of experience with noncertified devices would prove them to be adequate for interim use until testing (other than NIOSH) of the devices is performed.

However, to date, the staff has not received such a test protocol, nor information supporting the adequacy for interim use of these devices at VEPCO facilities.

We are concerned that current and future entries into containment while using these breathing apparatuses may constitute potential violations to 10 CFR 20.

We request that within 30 days of receipt of this letter, you provide this office with a discussion of how VEPCO's current practices as discussed above meets 10 CFR 20.103(e) and 10 CFR 20.103(f) without a request for an exemption from these regulations. Also, we request a schedule for submitting the testing protocol and information supporting the interim use of these devices.
