NOTICE OF VIOLATION:
EA 85-
(INSPECTION REPORT NOS. 50-280/85-14 AND 50-281/85-14)
A special safeguards inspection was conducted by a member of the Region II staff
on April 16, 1985, of activities authorized by Nuclear Regulatory Commission
(NRC) Operating License Nos. DPR-32 and DPR-37 at your Surry facility.
The NRC 1 s
concerns relative to .the inspection findings were discussed by Mr. R. Walker of
this office and Mr. W. Stewart of your office in an Enforcement Conference held
at the Region II Office on April 26, 1985.
The purpose of this inspection was to review the circumstances of a security
event reported by the licensee concerning an uncontrolled path from the protected
area into a vital area.
The inspection findings indicate that certain activities violated NRC require-
ments.
The violation, references to pertinent requirements, and elements to be
included in your response are presented in the enclosed Notice of Violation.
The violation referred to in the enclosed Notice is for failure to provide
positive control of access to a vital area.
I have concluded that a Severity
Level IV is appropriate for this violation.
Notwithstanding the above conclusion,
I believe a violation relative to
inadequate vital area access control to be a serious matter that deserves
management attention.
Consequently, in your reply, you should describe in
particular the actions taken or planned to improve the effectiveness of your
safeguards management system.
After reviewing your response to this Nati ce,
including your corrective actions, the NRC will determine whether further NRC
enforcement action is necessary to ensure comp 1 i ance with
NRC
regulatory
requirements.
In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and
security measures are exempt from public disclosure; therefore, the enclosures to
this 1 etter, with the exception of the report cover page which presents a
nonexempt summary, will not be placed in NRC 1 s Public Document Room.
