APPENDIX A NOTICE OF VIOLATION Virginia Electric and Power Company Surry 1 and 2 Docket Nos. 50-280 & 50-281 License Nos. D~R-32 and DPR-37 As a result of the inspection conducted on March 12, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violation was identified.
10 CFR 71.5(b) requires that "the licensee comply with the applicable requirements of... 49 CF.R Parts 170 - 189. 11 49 CFR 173.392(c)(l) requires that 11Materi a 1 s must be packaged in strong, tight packages so that there will be no leakage of radioactive* material under* conditions normally inci-dent to transportation.
11 Contrary to the above, on March 12, 1981, one dumpster in this shipment delivered to the Chem-Nuclear burial site at Barnwell, South Carolina was not a strong, tight package in that there were punctures in the front and bottom of the container.
This is a Severity Level III Violation (Supplement V.C.1).
Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within twenty-five days of the date of this Notice, a written state-ment or explanation in reply, including:
(1) admission or denial of the* alleged violation; (2) the reasons for the violation if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective-*steps which will be taken to avoid further violatiorrs; and (5) the date:~hen full compliance wil 1 be achieved.
Under the authority of Section 182 o.t ttie-Atomi c-6-n~rgy Act of 1954, as amended, this response shall be submitted under oath o~ affirmation.
